Passenger side axle removal question

Passenger side axle removal question
So I had all the drivetrain fluids drained recently, then I find out my passenger side cv boot has a little tear in it. I ordered a oem boot kit, just received that.
Now my question is, am I required to drain the trans fluid? I really don't want to because I just spent $90 on a gal of diaqueen to throw that in the garbage, I know fluid will spill out but I can just top the fluid off then.
I will hopefully be doing the job on a lift. Another question is should I order a axle nut and pin?
Help is much appreciated, thanks.

I just replaced my passenger side axle a few weeks ago.
It actually goes into the transfer case. I drained the case, but I don't think it is necessary. It looks like the axle is at a higher level than the fill plug.
I used the old nut, but replaced the cotter pin.

Why would I need to take the inner off? Then I might as well get another axle if this is the case?
I thought I'd remove the axle, cut off the bad boot, remove the retaining clip, hammer off the joint off the shaft, fill it up with grease then put on the new boot.

This, just to warn you that you might need another boot.
