So now I'm trying to figure out what you're arguing about. Nobody's debating whether or not the insurer will be suspicious of the claim. All I'm trying to point out is that there is no DUI and there is no citation that has been issued. If the claim is going to be thrown out it will for some other reason. Can we agree on that?

wow. I agree with some of the previous posts, this is the kind of garbage that makes our rates go up. That was a stupid move, kid. I pray his insurance sends him a big fat letter for denial of coverage. The car wasn't on his policy, and the car wasn't insured, period. Someone's f'd with a $36k bill.

I certainly agree. All I'm saying is they don't need a citation to prove it was a DUI. He's already admitted his friend was drunk here. If the claim is filed I'd be utterly amazed if it wasn't flagged for investigation. If flagged they will promptly depose both the insured and all witnesses. If he lies he's screwed...if he tells the truth he's screwed. Drunk driving is drunk driving whether by your own admission or the admission of a police officer. Needless to say I'm glad I'm not in his shoes.
