Friend's Evo was rear ended, need help.

Friend's Evo was rear ended, need help.

Alright just as the title says, my friend was driving behind me after leaving a little car event. Traffic was stopped so he was stopped behind me. Someone in a truck further back apparently tried to show off and do a burnout, and slammed in to him...




SHORT STORY FOR THOSE WITH A.D.D....
Friend was rearended, 12-13k or more in damage.(trunk, rear bumper, taillights, exhaust, both rear quarter panels are bent/cracked, plus much more) Its an 03 in great condidtion at 35k miles. Their insurance won't total it. Instead without his approval ordered a used rear clip.. THATS RIGHT used rear clip... Is this not illegal? Do they not have to use genuine new Mitsu parts? Can you order rear quarter panels from Mitsu? What should he do?

So it was the other guys fault. Anyhow he took it to a few body shops and they quoted in between 12-13.5k in damage. His trunk is messed up, bumper, both quarter panels are bent and cracked, taillights busted, the floor of the trunk is folded.(quite extensive damage) Yes the spoiler survived

He was hit while he was in gear, so for some reason his transmission sticks sometimes now. Finally the exhaust took part of the hit and pushed everything back, and now his turbo is leaking oil.(the car still drives ok..)

He initially went through his insurance because he couldn't get the guys insurance info for over a week.(the police department, a few hours away. Would not/could not fax him a report. Instead they made him pay 10 dollars by money order. Then they would send him a report)They couldn't accept credit cards..

Shouldn't that be illegal.? Not giving him the information?

Anyhow, his insurance looked at it and said they would total it. However when he finally got connected with the guys insurance they looked at it and said there was 9-10k in damage. They said they weren't going to total it out(which I personally would rather have it totalled) It is going to decrease the value of the car when you might sell it down the line, as this is extensive damage.

The main thing is they already, without his approval ordered a used.. THATS RIGHT, a used rear clip of an evo. They said it was approximately 7k, and that they couldn't order whole rear quarter panels new(which has got to be a lie)

So should my friend get a lawyer, or what should he do? I told him to tell them no. They have to fix it, or at least quote you for new parts correct?
Any help would be appreciated, sorry for the long post. Thanks

damn man thats ****ty, i feel for your friend. I dont know much about the whole law side of things, but from what ur saying, I would definately be getting a lawyer. Ive had a couple cars in the shop before and dealt with the insurance and everything was at my discretion, even what was ordered.
Just tell him to get a JDM rear when he gets done with it, and best of luck with the whole situation

That's basically it, at the worst he was going to order a carbon-fiber rear trunk(since it is basically the same price as a new one) a jdm rear bumper, and different exhaust, taillights, etc.

In reality he wants it totalled out, and I would too considering the damage. However them ordering a used rear clip without his approval is just craziness.

He screwed up. File it through his insurance and let them get the money back from the ther guys insurance. Tell him to call his insurance and tell them he wants it totalled. He pays the deductible and your insurance will get it back from the at fault driver.

Normally it takes 10 days for the report to be filed then you go to the poice office and it was 25 cents a page for me(w/e the cost it is worth it for your records.)

He really should get a lawyer, Insurance jobs should never use used parts. I With that much damage the car will never be the same. I hope everything works out for the best.

Thanks for the kind comments. Here is a couple pictures of what the car use to look like. (Mine is silver, his is red) I will get up pictures of the wreck shortly.

He needs to review his insurance policy. Most insurance policies alough the use of used and/or aftermarket parts. I dont think they can work on his car without his approval first though.

ya i was not very happy seeing as how the guy was driving a s10 of all things and tried doing a burnout behind me haha....

i have already hired a lawyer and we are taking this to court for a pain and suffering case " i missed a week and half of work" and i am now doing physical therapy twice a week because my back is F&^** up.

o well it will all be better when i get my settlement and a new car which we all know will equal === car paid for and buschur racing visit haha

not too sure about the insurance laws from where you guys are located, but in CA the person who is hit has the right to take it to any body shop they wish to, my dad was rear-ended and we took it to the body shop we wanted to and the guys insurance paid for all of it. get a lawyer, sounds pretty BS that they ordered the parts without your consent

Your budy should just let his insurance deal with it. Just ignore what the guy who hit your budy do...tell him it's the insurance business now.
The rearend wont be the same anymore trust me even if they fix it up.
