If I were in your shoes, I would contact the third-party warrantor. When they deny coverage, which they will, get a refund from them and put that money towards getting the (stretched) timing-chain replaced. Then move on with life with your no-warranty Evo X.
How can the dealership "broker" a warranty to you with the knowledge that the car had been modified and all possible future warranty claims would be denied?
First thing you should do: get a full refund for the Apex warranty.
Then: tell them you'll take $3k less and that you'll never buy another car from them.

I bought an 08 GSR in april and have driven it 4,000 miles. I bought it from a mitsu dealer with an aftermarket clutch installed by the previous owner. My Service engine soon light came on and i brought the car to autozone to plug in a scan tool and it gave me a p0014 which is cam phasing error, the ecm has detected the camshaft phase angle has exceeded its tolerance value...ALSO a code for random misfire on cylinder 4...and there is motor oil in my intake piping and on the air filter...
Bought the aftermarket "Apex Premier" warranty, which is good for 4 yrs 48K miles...
Brought the car to the dealer and service manager thinks its a piston ring or scored cylinder or somekind of engine damage...he says since the car is under 60K miles it should be under powertrain warranty...but he said the car was put back to stock before i bought it....this was not explained to me when i bought the car...also that there is something in the history that shows it is no longer under powertrain warranty....
Now i did sign the thing that says you are buying this car as is. But i also bought the aftermarket warranty
MY QUESTION IS: if i get totally screwed on this, what is the possibility of returning the car, asking them to squash out my loan, and giving me my down payment back (or my trade-in if its still on the lot)

Your best course of action is the see if your warranty will cover it.

Contact the warranty company first. When/if it's denied, go back to the dealer and ask for all your money back as they purposely sold you the car knowing it had already been modded and warranty would probably be void. Short of that, contact local media and have them do a story on the scandalous practices of the dealer. That should set things straight
I work for a local Bmw/Mini dealership and we get used cars all the time with either intakes, exhaust or just a stupid aftermarket part and let me tell you that you're pretty much screwed on the Mitsu warranty. Now you might have something to fight on court for the reason of not telling you that the vehicle was previously modified, also extended warranties ask for a lot of info if you do a claim and in this case if you have something aftermarket forget it.

If the OP has the time and money to fight it in court, I am not really sure if they would agree in the OP's favor. I'm sure the 3rd party warranty information was provided to him at the time of purchase, and if not, you usually have two weeks to read all that fine print and cancel the additional warranty if you do not find it satisfactory.
Companies perform unethical behavior on a regular basis and usually there is not much recourse available for the consumer. Anything that was promised or told to the OP at the time of purchase is nothing more then hearsay. The only thing that holds up in court is whatever was in writing. I bet the OP didn't bother reading all the paperwork, including the 3rd party warranty paperwork (Sorry Iowa, I am not willing to bet beer on this one).

If u bought there warranty u might fight it but other than that they won't do crap for u dealerships are crooks u can try putting them on blast like hit up a news station and see if they can help u out we have a news station in Vegas that does that and 9/10 they will agree so they won't look bad
Wow! Sorry to hear about your predicament. That really sux. Truly wish I could offer some advice but I am at a loss. I bought a used 2008 GSR myself. However, I brought a friend with me. Both of us know the tell tale signs of mods such as new bolts, how dirty or clean a part is, looking for rust or corrosion build up where it should be, etc... I had the dealership put the car up on the lift in the service department and take off all the under body panels so I could see all the parts. I also had the service department pull up all the records on the car and print me copies before I agreed to purchase it. They tried very very hard to get me to buy an aftermarket warranty but I refused.
All I can say is best of luck to you and I very much hope this works out in your favor. Or at least you don't get raped. Please keep us posted.
