Its been a while, but I finally got a response from him through email. Check it out.
And I also just got off with my brother in law who is a lawyer for the city of orlando. He advised you to let you go ahead and sue for the following reasons,
1. You never had the kits installed by an ase certified mechanic. As I recommended.
2. You never had the kits tuned professionally on a dyno as I reccommened a million times.
3. I paid for the kits to be returned and I rebuilt them and reshipped them for free.
4. I have witnesses who saw these kits built and working on a prototype car.
Are you a car mechanic? No you are not, you should never have tryed to install these by yourself, and you probally messed them up in the mean time, can you prove you didnt? No you cannot and the judge is going to see that. So if you want to go ahead and sue do it, hell I to get out of this town anyway, I will gladly bring myself and my lawyer down there. I will also let you know the minute I see a suit handed to me, I will be filling a countersuit for my traveling fee, my lawyers expenses, his traveling fees, and both of our hotel and car rental costs to come to texas to settle this.

I like how his counters are things I didn't complain about. Like getting it tuned and installed. I couldn't even get it on to be tuned and (even though I would need it in court), it doesn't take a professional to see if a pipe won't fit between two things. Since he deleted his website, I have no proof of what was supposed to be included so I don't really know where to go with this. $380 is a lot, but is it worth it?

I'd say yes. Why not get everyone who was jipped by him to form one massive suit against him? He might be able to dismiss one "bad apple" but when a dozen people come forward to say how they got the wrong/broken parts, it'll definitely paint a good picture for the judge.

I'm willing to put my name on the complaint if it helps. The other two guys I contacted were interested as well. I think if we got enough people it would be harder for a judge to throw it out. The other thing to keep in mind is that he will probably have to pay your legal expenses if you win.
And that static about him even having a lawyer is BS, it's pretty clear from reading the email...

Aaron couldn't do anything since Phillip deleted the history on the website so everything is gone. Correct me if I'm wrong...but I'm pretty sure you can't counter sue someone just for the expenses you have to pay for court, you have to be actually sueing them for something, right? And yeah I thought about getting notices from everyone who got screwed, but can you do that to one person, or does it have to be a large company? He definately doesn't have a lawyer, and if his lawyer said to countersue for the expenses, I could care less. And lastly, for small claims court, would he even have to travel? Or would they send him my evidence and ask him to submit his evidence and make a decision based on that? Thanks for the support guys. I really don't want to just let this go. And I want him to know that he can't just f--- people over (especially here) and get away with it that easy.
sue him in small claims. the damages you are seaking are too small for a full blown claim. It costs about 40$ to file a suit in small cliams and you dont need a lawyer. Just have a well presented case. If he does not appear you win by default. Then they chase him to pay damages. If he deleted the site he has no proof of what he said either so it will be his word against the entire evoM community. Wonder if this litle ***** loses sleep over the fact that an entire online community wants to sue him not for gain but for the fact that hes a tool. . .
