need help car accident

need help car accident

ok, someone ran a stop sign and hit me,
he said it was his fault and told the cop that.
and his insurence company said it was 50/50 than it changed to 80/20 and me being 20.
it was 100% his fault though, so i told his insurence company i will sue them if i dont get 100% so they said 90/10.
now i just got a letter in the mail saying that they guys passenger has been injured 2 weeks later after the accident and a 2 days after i told the insurence company i was gonna sue them.
i think the insurence company told the client to do this, i need
can the passenger even sue me even though it was the other drivers fault, shouldnt the passenger be suing that other driver?

if you were not at fault in the accident then the only liability lies in the driver of the other car who hit you - in other words the passenger can only sue the driver of his car.

thats what i thought, but they're trying to sue me! but im taking them to court so does that still make him liable or do i have to wait until the judge says its his fault

There's no way you're responsible for injuries received in a crash you didn't cause. They might as well sue the Pope.

This is a prime example of why I hate insurance companies. I would be willing to bet this is a scare tactic to make you feel like your lucky to get them to cover 90%. Their job is to get you to settle for as little as possible.

Get a lawyer and go after them. Sue them for your legal expenses, repairs to your car, the loss of value of your car, the cost of your rental while your car is being repaired, any medical bills and, any time you have to take off of work to deal with this BS.

I'm not a fan of law suits but, that is complete BS what they are trying to do. If that person ran a stop I don't see how it is anything other than 100% his fault. I went through this same crap when my wife was T-boned in her 3 week old Lexus by some dumba*s without a license who ran a stop sign in his under age girlfriends truck. The car was totalled. I tried being nice at first and then tried to screw us. All I wanted was the car replaced with my existing loan. It didn't even have a 1,000 miles on it. Finally after getting a lawyer and months of litigation it was resolved but, it sucked the whole time.

yeah, they're gonna pay for court,attorney,rental car, but i didnt think of lose of value, but i will consult my attorney to add that onto the list

HIRE AN ATTY. u will need one, i was hit they did that **** to me i won the case, got my **** paid for and got 23k in addition, then i sued the crack addict driver who ran the stop sign and hit me, i had to go through knee surgery and a bunch of physical therapy i ended up winning my case against her and got 13k for med bills which is what i sought for her to have to cover, not like i will ever see it, she was 22 white trash on welfare with 4 kids and no job

I hear yah my daughter got t-boned ( car flipped and is totalled) and the insurance told me 675 for her injuries. She was luck and only has a little pain. I told them no thanks I have 2 years to sue or settle.

Yup get a lawyer.
