Hello all! I would like to apologize for this being my first post/thread here as it is not a good way to start off. I do have plenty of great transactions on other forums, my user name is the same as it is here.
I have been pursueing an Evo for about a monthe now and both vehicles that I have made an offer for have not ended in my favor. The first was a local car that the seller decided he didn’t want to sell after I had offered him full price. The second, well honestly I don’t know where it went wrong but I don’t feel as if I am to blame for it and Joemflsxe is holding my $500 deposit even though I am ready to complete this transaction.
Here is my story about trying to puschase Joemflxse’s car.
It all started great on 11/8/12 when I spoke to him by PM then on the phone and we struck a deal. Right after that I went and Paypaled him $500 as a deposit. The next day I went to my credit union and filled out all of the paperwork and spoke with my loan officer about payment methods. We also spoke to his credit union about the lein and how to satisfy payment and also have some security since I am in NJ and he is in Fl. My loan officer suggested that they send payment for the lien to his credit union and then he mails the title to me and then I send him the check for the balance of what we discussed. I left the credit union and proceeded to call him and go over the details to which he verbally agrees. We also email and speak and he suggests a shop local to where the car is kept to do an inspection.
So far everything is great!
On Monday we speak again via email and set up the appointment for the inspection which I am paying for, I also called my insurance and insured the car, and also arranged for an auto transport for 11/17/12 where the car is stored. Tuesday morning he emails me and tells me it will be there and he will call me later in the afternoon. I call the shop to speak with someone about what I want them to check for and whomever had come with the car was long gone and she just complained about paying for an inspection so they did a quick visual. I told him I wanted a compression test and that I was paying for it not the seller. I speak to the seller on the phone and he apologizes and said the car would be there for inspection the next morning which I arranged with the shop. Well, the car never arrived at the shop for the inspection but now he starts telling me that the payment method we spoke of won’t work and that I am a scammer and don’t have the funds. I email him repeatedly, since he won’t call or answer the phone when I call, and try to figure out how to make this work. I find out a distant friend is local to him and offer to send the certified check with my friend so they can deposit it and sign over the title….should work for everyone! I also tell him to call me so we can discuss but he refuses to call. I email him and tell him I will fly down Friday and stay Saturday to get this done. He says he doesn’t see how that would help it get done…..He says cash talks…..transfer the funds and you will get the title and car when the check clears. LOL.....I could fly down with a certified check and make it happen!!
When I told him there is no way I will wire him around $20k without some security he completely stopped responding and now he is refusing to communicate or give me back my $500 depsoit.
This morning, even though I am sure this deal is not going to happen, I call my credit union who again confers with his credit union. His credit union (lien holder for the car) suggest having him give power of attorney for the title. If he signs and notarizes it and overnights it to my credit union we could have this done tomorrow and all would be happy. I emailed him to tell him this and still no response. I even said if he doesn’t want to deal with me anymore just refund my deposit. I give him all day to respond and nothing. So, I just made a dispute with Paypal for the money.
At this point I am just disappointed and angry. I told him to contact my loan officer but he refuses. He won’t even get on the phone to discuss. I asked him for suggestions that would work for both of us and all I get is him asking for the balance to be transferred to his account. I hope anyone that is going to try and buy the car to be very carefull, something seems strange. If he was a man of his word I would have my deposit back. I found it hard to communicate with him. He would email but he never once answered his phone when I called him or returned calls from voicemails. He did respond to emails but I don’t sit behind a desk all day. Also when he called all that came up was 850 which was strange.
I have all of the emails from our discussions which I will post if he wants to go there.
I hope no one else looses any money dealing with him.

Sorry to hear that bro. I just boghut my evo from a fellow board member and I am in South Korea at the moment. Thankfully he was very honest and a man of his word. Hope this gets resolved for you.

Yikes sounds like a sticky situation, honestly thou i would never even think of buying a car that has a lien on it or owed money, plus its outta state to much can go wrong there. I got mine from a dealer but haggled and went thru my credit union for the Rest of the cash i needed.
I hope you either get refunded or the evo, Good luck.

This doesn't make any sense. In the case of a lien, all you have to do is call and get a 10 day payoff. From there you have two options. You can make the payment of the lien amount to the lending institution, and pay the rest to the seller, or do like I do most of the time which is to pay the entire amount to the lending institution. I didn't even read this, heres the emails. First the guy wanted to send separate checks, my credit union declined, then he offered his "friend" who is local to come with a "check", and his latest request is for me to sign POWER OF ATTORNEY over to him so he can "transfer" funds. MY credit union advised me to stop all contact me him, his paypal deposit (I didn't even ask for) is in the process of being transferred, this guys a jerk off.
I was in the office with my loan officer and she told them she will send them the payoff amount. Then I will hold the rest of the money, difference between the payoff and the $20k we agreed upon in a certified check made payable to you. Once I receive the title I will overnight the second check to you. This ensures everyone is safe and this is what we discussed. If this isn't going to work for you let me know.

I just told my credit union verbatim what you explained and they said that's a scam/shady and highly advised against even responding to you at this point. I really don't know what to tell you, contact my credit union and pay for the car like a normal person if you are legitimate (I'm hoping you are it's just your bank making this look bad). Okay, I just got off the phone with my loan officer and this is what would have to happen.
- Transfer funds to my account ($19,500.00)
- Once funds clear the car can be picked up and the title released
It's really irrelevant if you fly down here, funds cleared = you get car. So it's up to you, the shop can still do the check up anytime.
I've gone through two separate loan officers at my credit union and one at my main bank and all three said the exact same thing. If you are legitimate please do not take any of this the wrong way Mike, it's what I'm being told by the people who still own my car technically (my credit union).
If this works for you lets make it happen and I will give you a call, but I'm not calling to argue about this process. If you can not make it happen say so and I will refund your deposit in full minus the 3% PayPal transaction fees.

I have a friend close to you that will come meet with you and go to your credit union where you can clear the check and give him the title and the car.

I am not trying to make you mad but my credit union has also informed me to proceed with caution.
If there are any ways you can think of where both of us have some protection I would be glad to hear them.

I would highly suggest you both go your separate ways (aside from returning the deposit). I see faults on both sides. The seller should have been more cooperative in trying to have his credit union speak with the buyer's credit union to determine proper arrangements for a transaction. The power of attorney portion is pretty standard fare for releasing the title once the loan has cleared. On the other hand, if the seller can confirm with the credit union that the title will be released to him after the lien is cleared, there is no reason to withhold the remaining amount until the title arrives. Both parties contributed to the problems here, and there is no sense in continuing to argue about a purchase that isn't going to happen.
I have purchased and sold vehicles with liens long-distance without seeing them twice now. Without buyer/seller communication and banking institutions that are willing to talk to one another, it is a stressful and difficult thing to do. You should both learn from this situation and hopefully it won't happen in the future.

I made it perfectly clear what was required, he didn't pull through and things got complicated. Now the car is back on the market and I have a few people seriously interested that seem to have their act together. I'm not doing any business with Mike at this point and have no reason for further contact, the paypal deposit HE demanded he pay is processing... if you got a problem Mike file a dispute.

This is why I offered to do it all together.... Or even fly there to get it done. All with no suggestions from him. All I need is for him to do the power of attorney and he would have had his check today.
