Maybe but I have to report any traffic violations that exceed (or = I think) $300. To me it's about the honesty of the situation. I've been driving 14yrs and have never had a SINGLE incident. I do not want to plead guilty by paying the fine when I'm innocent.

Some pictures from today.

Picture from the West Bound side of I80 showing East Bound I80. Two lane Traffic at the sign.

First sign. Note....NO BEGIN CONSTRUCTION signs were posted before this point. Again 2 lane traffic.

This one needs explaining. The road I'm on merges onto another road. Thus the Yellow Sign is warning that our right lane ends because of the 2 merging interstates.
Yes there is a right lane closed ahead. No distances to closure. People in right lane. Note If we are in a construction zone at this point, why the 65mph speed zone?

Next Sign...watch for traffic. Notice both lanes are occupied.

Ok in this picture you can see the turn around at the Electric Sign. Sign said nothing of the closed road ahead. Only about closed exists. Again, both lanes occupied.

Closer shot of the turn around. Again, this was where the officer was facing on a 45 degree angle to traffic with lights on near the left lane. Generic Road Work sign ahead.
Notice not speed limit signs? People STILL in both lanes. Notice today the cop is down by the Exit Ramp in the right lane? He was NOT there on Sat. Also note that again, no one working in this area.

Little closer view. Vehicles in both lanes. some traffic merging. Cop sitting right at the exit ramp in right hand lane. Again not there yesterday. Barely see the Right Hand Lane Closed Ahead Sign.

Guy signally to come over. Near the blue sign in relation to above photo.

Close up view of the previous photo. Again Right Lane Closed ahead sign.

Finally the "real" merge left sign. This is at the point I'm starting to slow down to around 10mph. I start to signal just under the underpass.

Taken just past the underpass. You can start to see the flashing signal I was talking about and a few cones. Again notice not speed signs and no one working.

Close up of the Signal and cones.

Panoramic view from the opposing East bound Exit down towards the over pass and the electronic arrow. Note I'm signally under the under pass on the very right side of photo. Note the gray car in front of the SUV. That is approximately where I pulled over. Notice in relationship to the electric arrow on the left side just in front of the tractor trailer.

Man it looks like you've done your prep-work for this case - diagram, photographic evidence. This should be a no brainer for the judge, granted the cop shows up. Seems to me the DOT in this area took a 1/2 day when labeling this a "construction zone".
Negligence on THEIR part, NOT YOURS. AND you're not always in the wrong as stated above. I would NEVER plead guilty when I know I haven't broken any laws.

Good luck man!

Brett

Thanks brother. Been getting advice other places, so I've started my diagramming and photos. Not going down without a fight.

I wish you all the best, but my advice is to be prepared for the worst. You will not get out of paying the fine. In the laws eyes, your case is not worth the paper its printed on which is why they gave you the lowest, no points, no other repercussions fine in the books. Just that it happened to be in a construction zone is icing on the cake for them.

Its a bogus citation and everyone knows it, but when it comes to either the state, or you parting with money - you stand no chance. Not trying to demean all your hard work, but for a no points citation, they see it as being that they already cut you your break. They are just looking for that check in the mail.

The problem is that the ticket doesn't have the fine one it. They said to call Monday to get the fine amount. Are they supposed to put the point amount on the ticket or does the clerk tell me what the points are? Again, you sure there are no points associated with that ticket?

None at all if it's a failure to obey a traffic sign

I do not know if there are no points for that citation in OH. In PA there are not any points associated with failure to obey a traffic control device. They do not put the points on your citation, you usually get a letter in the mail identifying all of that. Its not up to the cop to assign the points, its up to the state.

You could always try the old trick of overpaying your fine. When they mail you the refund, dont ever cash it. Back in the day, they used to not be able to close your docket if the money wasnt balanced thus never resulting in points, or anything on your record I dont know if that trick still works or not.

What you want is going to be hard to pull off.

You were given a ticket for speeding? How much? Or was it something else?

What you might want to try and get is a 1031. Failure to obey a traffic control device.

No I was not given a ticket for speeding. I was given a ticket for not merging at the right spot (). Have to call on how much the fine is.

Apparently a 4511.12 in OHIO has 2 points associated with it.

After reading:
Ohio's Chapter 5501:2-10 Traffic Fines in Construction Zone

(A) The state department of transportation, county commissioners or board of township trustees (agencies) shall authorize the posting of signs indicating that traffic fines are doubled for speeding within selected construction zones under their respective jurisdictions, and that penalties for killing or injuring any person within those construction zones are increased. This provision shall apply in any construction zone on a multi-lane divided highway where the work is expected to last thirty days or more, if the planned work length is at least one-half mile long, and if the construction zone is stationary. The signs may be erected in any other construction zone at the discretion of the director of transportation. Signs may be erected for construction zones located on other highways meeting the foregoing requirements if required by the agency’s procedures adopted under paragraph (C) of this rule or at the discretion of the director of transportation.

So fines can only be doubled for speeding according to that OH code from the gov website. So might be good news there assuming it's written up correctly.

ALSO

(B) The signs, sign location, and mounting shall be in accordance with the following:
(2) The first sign(s) shall be placed between the “road work ahead” sign or other similar warning sign and the next sign in the sequence. Additional signs are required for long construction zones or where ramps or through streets junction within the construction project work limits. Signs shall be erected on each entrance ramp, near intersections of through roads to advise entering or turning traffic, and at least once every two miles through the construction work limits.

There were no signs indicating that fines were doubled in that area.

Geez Brant, that sucks.....I feel bad- if you never came out to the Mid-O event, you wouldn't have to deal with all this junk..

You were obviously targeted because of the car....if you were in some rust-riddle car with Ohio plates you would have never been pulled over
