Legally, you have claim against the mechanic, AND the maker of the failed part for damages incurred. The real dispute will be between the part manufacturer, and the mechanic who installed it. Let them battle it out, so long as you get what you need to fix your car.

I would cease speaking to the mechanic and the parts manufacturer, and consult a competent lawyer with the mechanic's invoice in hand. Let he/she handle the correspondence, as both parties will try to indemify themselves of culpability. You should be seeking compensation for damages from both mechanic AND manufacturer.

And BTW, get a different, competent mechanic to fix your car from here on out.

BTW, be sure you gather all broken parts and try to loosely piece them together.

I see a HUGE bluish hotspot on the flywheel's friction surface, and it looks like it may have come apart initially as you suggested. That needs to be looked at carefully by an independent expert who would know what to suspect after inspecting those parts.

lol same thing happened to my srt-4. hood flew open, giant hole in the hood, tranny broke in half and my block cracked all down the back... bent my axles and all....

mine was due to loose factory flywheels bolts

EDIT: mine happened at IDLE after i did a small burnout... but happened hours later. I tried with lawyers and this and that....and just saying ive been to the track ONCE ruined everything.. and the fact u said u were boosting... I would erase any info u have on ever beating on the car. Stupid I know but just trust me lol If you plan on doing the lawyer root... delete this thread too!

Actually usually you can pull the data, i have in the past working for Toyota and doing a motor job; warranty asks us to pull the check engine code and the details, when you check the code you can also check when the code came up. like when your motor stopped or misfired, it will show at 44mph, 5200rpm p401 or whichever code came on. so if theres a check engine light, they can pull data

Here's my bill of sale, give me my 31 grand!

Yes, my STi blew up, yes it was your fault, yes I will happily accept a check for 31k and go out and buy myself a brand new one. I'd have to have a very extensive amount of mods on a car for it not to be worth it, and even then, KBB and an appraiser don't give a **** about mods either.
And that's the point, that "if" - it just doesn't work that way. For instance if I buy a car brand new for 31K and drive it for three years and some knucklehead mechanic causes it to blow up, why in the world would I be entitled to 31K? I got three years of use of that car before it got totaled. Same thing if it was lost in an accident or stolen. He is entitled to what the car is worth TODAY/NOW, not three years ago or five years ago, or five minutes ago. Sometimes, some insurance companies will make exceptions for people with cars 1 year or younger 12,000 miles or less.

KBB, NADA are good guides to trye to eke out the most cash, Black Book is the most harsh. You'll want to do for Private Party or Dealer Retail value whichever is highest, but most likely they will try to make you take Loan or worse, Trade/wholesale value.

I pray things work out for you, OP.

Well, it's a long process. Which I pretty much knew was going to happen. As of right now it looks as if the flywheel company is going to pay for it. They have the parts back at their place "reviewing them." As for damages, my mechanic quoted as about 15k in damage, so most likely I will get 15k plus the car or whatever the car retails at. Wish me luck.

"The" flywheel company? If they are going to cover it I would say that's a damn fine company I would consider doing business with. Anyone who would stand behind their product like this deserves some recognition for it.

If they do cover it consider telling us who "the flywheel company" is and especially if they don't that way we can bash them on here and they won't sell any flywheels to evom members... =)

Even if they do fix everything, I hope you kicked your mechanic in the nuts and told him to do the world a favor and stay the **** away from cars. He is a scam artist for sure... His lying about what parts he put in your car and ****ty install job almost cost you your life and could have killed someone on the road around you...
