Car Dealership Fraud?

So i bought my Evo 8 from Cherry Hill Triplex about 2 months ago. They showed me a clean carfax and said the car was never in a accident, well about a week ago i met up with the guy who had it before me. He told me that it was in two accidents (not a little bumper tap either ) and the dealership knew about it and it was reported on carfax. So now i know that i pretty much got screwed over... But is there anything i can do? Did this ever happen to any of you before?

Did they show you a clean carfax online? if the car was hit and fixed without an insurance company by someone it probabally wont show up on the carfax. have anymore info? this could possibly be a case for you to fight under Lemon law.

Well one of the past accidents happend after he got new tires on the car. The shop forgot to tighten the back right lug nuts and it fell off while he was driving and he hit a pole or something....

That was reported to the insurance company and he ended up suing the shop. He even said that it showed up on the carfax when he traded the car in.

The dealership printed out a carfax report to show me it was clean.

When i was talking to the past owner he asked me if the ABS light comes on if you cruize over 80 - 85 and i was like yeah. He told me ever since that accident the light always came on...

He also showed me taht you can tell both drivers side doors were replaced because the bottom hinge was unpainted i didn't even relize when i was lookign at the car before i bought it....

I have class for a hour but i'll be back soon. I need to figure out what to do....

it depends if the accidents were reported. if they were just fixed privately and not reported to insurance companies, it will not show up on carfax.

talk to the previous owner and find out as much info as ur can, such as, where it was fixed, etc.

then do ur own carfax on it, and if the accidents come up then talk to the dealership.
i hope u have a copy of the carfax they showed u though. or else what proof do u have except ur word against theirs.

if u have that kind of evidence, talk to a lawyer, maybe u have a friend who can give u free advice, don't just barge in and make a scene. because if this is true, u want to be the professional since they are not.

If I am not mistaken that story about the wheel falling off is here on EvoM somewhere, maybe another case but I am almost certain I read that.

Do this, but instead get a copy of the accident reports from the police. The Carfax could be clean and still not reflect accidents and service on the vehicle. It all depends on what reporting was done. Regardless, they did you wrong by showing you a clean Carfax as evidence that it was an "accident-free" vehicle, and they need to make it right.

Well i have the accident reports from the previous owner and he is willing to help me out because he traded this one in for a white evo and he is starting to think they lied to him as well...
Now do i ask for some money back or just tell them i went them to buy the car back? What would be my best option?

Most likely i will be talking to a lawyer to see what he can do as well.

On top of this the clutch is starting to slip so untill this all gets straightened out i will ride that clutch out as long as i can lol

You get the carfax from the previous owner of the car, and the repair orders, possibly the police report if that is readily available. You make sure he reported it to his insurance, if there is any paperwork that he will show you without too much of his personal information and you get your **** in order. Did you recently go on and get a carfax on it? Was it clean? If it was not then they probably fixed up a template and printed it off to show that it was clean when in fact it was not. Everytime I look at a used car I go online and order the carfax myself, never trust the dealer, they are called stealerships for a reason. Not your fault at all, just get your ducks in a row then go and call them out. Demand that you speak to the owner of the dealership and explain what happened, show him the paperwork and Evoryder was right, say I want a new car or you'll be hearing from my lawyer. It might work under Lemon Law, however you definitely have a solid case of fraud it sounds like. Stick it to them, its people like this who sell cars that are faulty and cause injuries, and who will scam you for every dollar you have, so take no prisoners! Maker sure the story with the previous owner is the same and I would go in together, two heads are better than one...

Lol thanks! I am going to get my own carfax tonight, i already know that its going to show up. I will report back later with the info on it.

I would rather have them buy the car back. Wait till it reflects on your credit report for a better score than take my business some where else.

I had a similar incident where the dealer tried to sell me an accident car as new.
Check the fenders for the original vin tag (small paper sticker with the vin).

This is how I got them to swap for an Evo that was on the show floor.
Car dealers are one of the worst people when it comes to scamming.
