Well, today is the day. I'm supposed to hear from Mitsubishi as to whether or not they are going to buy my car back. I will post the answer tonight. They are still worried about my turbo timer causing this problem if you can believe it. I sure as hell can't, the damn thing has been in there since june. It just decided to **** something up 2 months ago? I don't think so.
Victory is mine. I will be getting a new Evo. The guy from mitsubishi called me tonight and told me I had two options
1. They buy my car back, I give them a little cash and get a new car.
2. They grab a couple of mits. engineers and some parts and come and try to fix it again.
I'll take option #1 thank you.

I know you have had more than your share of hardships and are probably worn out from the whole thing, but I gotta say, SCREW THEM. New car, no cash. It is the least they could do.
Lets say they ship the car to corporate, put 10 engineers on it and fix it. That means your car is worth on the market about 24k. Mitsu has less than that in a new car, so they are coming out ahead.
Just tell them you want the keys to a new one, even trade in, end of story.

No, I did not have to get a lawyer nor did I actually have to go through with the lemon law. I did file a case with the National Center for Dispute Settlement and that is what got Mitsubishi moving finally. It seemed to me Mits. was going to be content to leave it the way it was, where my car was not fixed but not exhibiting the problem as drasticaly or as often as it was when I brought them the car. What really pisses me off is my district rep. He was basically telling Mits. the car was fine and they shouldn't buy the car back, dragging his feet on paperwork, slow to return their phone calls, just generally being a douche bag. If I had not been calling Mits. everyday and giving them my side of the story and all they heard was his side of the story the supposed facts there is no doubt in my mind I would be stuck with this car. i would also like to thank the members of this forum for arming me with some of the technical information that I used to help overcome the evil empire. I really feel that if i was your average car owner(not a car nut) they would have really stuck it to me.

Congrats HotRod...I'm currently embattled with Mitsu over my Evo. I have a arbitration hearing on April 16th and they are resisting a buy back.
I bought my car Aug 18, 2003. On Jan 29, 2004 my number 3 rod bearing failed as when I down shifted into 4 gear to take the passing lane and pass a slower car in front of me. I had 14,500 miles on her at the time of failure. The dealer repaired it. My car was in the shop approx 12 days. On Feb 29, 2004...about 2 weeks after being out of the shop and about 1000 miles later, my number 4 rod bearing spun in exactly the same manner. I was excellerating in 4 gear to tak the passing lane and move through slower traffic.
Funny thing is that I babied the car for the first 1000 miles out of the shop "just in case". When I decided to get on the highway and open her up...BAM. Dang thing broke again.
No I did not miss a gear and I didn't redline. I was watching the whole time specifically to see if everything felt and sounded okay since that repairs.
Mitsu DM/Corp is claiming I abused and neglected my car. My battle continues. Do a search on my name or "lemon" and you should see my thread here. I also have a more current thread at DCEvoClub.com.
I am fighting to get out of the car entirely and while I still think the Evo itself is a great car. I WILL NOT get another one.
