Or they removed some other mods and left the old tune.

It was stage 3 from Cobb, and they also installed it. The car was brand new when I got it. 2300 miles on it when the piston went through the block.

Cob Stage 3 includes:
Accessport
Intake
Inlet Hose
Downpipe
Test pipe
Catback
EBCS
Cob decal (this adds the most power)

You are saying the dealer installed an aftermarket set up on your new car, and they are denying you warranty?

That's BS, if they don't warranty aftermarket parts they install, they shouldn't have done it in the first place.

I didn't even know dealerships installed aftermarket car mods. Did they even install the tune on your car? or just the cobb stage 3 bolt-ons? Did they give you an Accessport?

They had Cobb install it, they gave me an access port. Said it was tuned. Yeah like I said I thought it was a good deal that they included it. Dealership said mitsubishi won't allow them to cover it. It's some kind of nightmare going through all this.

On your bill of sale was there any line item which stated you paid for the Cobb package through the dealership? If so, I think the dealership should pay for your new motor, there is no way a car that new would blow a motor, something must have gone seriously wrong during the install.

Did you datalog with your AP during your 2k miles? If so, it would probably tell you if a lean AFR or overboosting blew your motor. Do you know if Cobb just loaded a OTS map? or was a custom tune?

I think it's completely wrong for the dealership not to cover the damages, especially if you paid for it through the dealer. There must be something on the contract that makes them liable, since you paid for it through them.

I think you can hold cobb responsible too, if they indeed did a custom tune. It might have been a bad tune.

Yeah....I highly doubt the dealership is going to pay up on this one, and if they do, it will only be an attempt to keep the customer from creating a headache for them.

No way Mitsubishi is going to pay for this, so that is dead end #1, as crzy as already found out. And if you look at service records from dealerships, most of them have legal disclaimers claiming that the sellers assume no warranty on installed products... warranties are only granted by the car OEM (Mitsu), or the manufacturer of the installed parts....in this case, I assume Cobb.

The dealership may be willing to help you out, but I'd be shocked if they covered it.

crzy - any documentation on the Cobb install regarding warranty of installed parts? My guess is probably not, but you may want to pursue working with Cobb also to see if you can get some help on the repairs.

Yeah corporate would never pay for it, but I feel the dealership and cobb should be responsible.

I'm still shocked the dealership would sell a mod package that would instantly void your factory warranty.

There is nothing on the bill of sale that says Cobb, but just some extra stuff that hiked up the price. I never expected a car this new to blow. Not sure what kind of tune it had pretty sure it was a preloaded map though.

I talked to a couple dealerships, one even told me to file an insurance claim and have insurance fix it, but I don't want that to affect my rates. The only reason I gave the okay on the extra parts was because I thought warranty would cover it.

I didn't data log at all, I only had it for a weekend car. I had contacted Cobb before it blew and asked them about the jerking. I was told that many people have been running that set up without problems, and that I was probably accelerating at to high a gear. Contacted after it blew and I was just told to bring it in and they could tell me how much it'd be to fix it.

Mitsubishi already shot me down. I've been talking with the dealership with the sales department to see if they can help. *got my fingers crossed* but I don't want to get up my hopes up. I am slowly running out of options.

I haven't read through but can only imagine it has already been mentioned. Hire a lawyer, it is worth a couple hours of their time to understand your rights and options.

As brilliant as we (forum people) are, we probably aren't your best source of legal analysis...

Unfortunately unless you have alot of money thats not a good solution it will cost you 25-40k to pay a lawyer to sue them. And right before trial theyll hit you with 50+ motions and run the bill up I've been there. Your better off taking them to small claims and taking the 5k youll win from that and running away.

First question is... Did you mess with the tune using the access port they gave you?

11k?!?!?!?! WTF?! I know for a fact that the cost for our dealership to buy an entire crate motor, including the turbo, is only $4,600.

Next step is contact an Attorney ASAP and tell them the story to at least see if you have any options.
