okay lets say hypothetically speaking he didn't know, neither of them knew which i don't think is the case on the sellers part but he knows now and should do the right thing and give the buyer his money back for the product. That's from my understanding where the whole thing went wrong. The seller now knows but doesn't care that he made a misrepresentation of the item to clearly get it sold.

Are you kidding me??? It is entirely your job as a buyer to make sure you're not getting ripped off. You're buying stuff off of some random guy...
