question on Transfer Case

i've heard a little bit about how they go out on Evo 8's

from what i can tell is that it's not as comon as the Clutch issue, but is still a common issue. So i had some questions

Why does it happen? just bad design?
When does it happen? is it just a problem when people lauch?
I've seen out people talk about new fluid helps the problem?

Sorry if this had been posted before, but it's something i did a little research in,

Some say they are shimmed wrong from the factory, some say the transfer case is fine and that its the spider gears of the front diff that blow causingn transfer case failure and some say as long as you don't wheel hop on the launch she will last forever.

Most of the tc problems have been due to wrong fluids put in which ****s up the ring and pinion which will cause a whine!! Spider gears inside the diff brake with 6k clutch drops or can break with wheel hop. Most of these break in 03-04's b/c of the open front diff and its garbage! The 05's have a helical lsd and should be stronger, dont know if anyone has blown one yet. I know Nolimit's 05 tc blew but dont know the reason. Get a spider gear upgrade from TRE I will be doing that soon or get the Quaiffe LSD!!

Wrong fluids and wrong launching techniques. Slip the clutch don't drop it.

Yes they do go out... I have an 05 and have the whining in my transfer case i think i'm gonna try to upgrade the spider gears soon.

the bolt to my transfer case had somehow came out to my transfer case,and drained it dry. i dont know how, it has to be the dealerships fault, but ofcourse they are not taking blame. ive been argueing with the service managers, and they are suppose to come to a decision soon on weather they are going to cover it or not. if not its going to cost me 4800 dollars. any ideas on what i could do? could it also have done any transmission problems to my car. they are saying it could have done that, but i dont know how.
