IMO, I disagree. I think it could be possible to outlaw something that used to be legal. It does happen. Not everything gets grandfathered in.
Also, specific to this, just because it is legal to sell it doesn't imply it is legal to use it. Guns come to mind as an analogy. Guns are legal to sell, but plenty of illegal usages for them. Same with fireworks in some areas or radar detectors.
I think there is a very good chance this guy will get off of this ticket. The fact that it comes from the factory does help the case, but the main legal issue is whether the car violates the law. The way I read the law, it does not because of side rear view mirrors.
DRYAD--did you ever post the actual state statute number from the ticket that they wrote you up on?

UPDATED wing ticket
I won, thats all that really needs to be said. This was the first time the appeals judge looked at my case as he took some time to read the entire thing. He looked at me, my lawyer and the sgt. that was with me and then looked at the DA and blurted out "This is an absolute waste of time to actually be spending on this case. I consider this case over and done with, this case is dismissed."
After 5 months or so, the nonsense is over. All I want to say is thanks for everyone's support. Granted I had to pay no money to the city I still in my mind lost because of all the time I had to take off of work. Goes to show that the county still won.

Congratulations on your victory. Sorry you had to go through the BS with the courts and time off work. Did you speak to your lawyer and ask if there was any way you could get compensation, especially seeing as the appeals judge called the case a 'waste of time'?
i got a ticket just 2 days ago for "chirping my tires" when i repeatedly tell him it was my BOV. so he told me to rev it i did and hes like all i hear is your loud illegal exhaust. so im gonna make a video of my car driving to take to court
