depends on the state da probably can appeal to full appelatter court, ask that 3 judges hear the case and give the rulling if that don't work then they can appeal to state supreme court.

edit:also depends on load da currently have, if work load is small most likely appeal will follow, if they are really busy probably not appeal the case.

I won, thats all that really needs to be said. This was the first time the appeals judge looked at my case as he took some time to read the entire thing. He looked at me, my lawyer and the sgt. that was with me and then looked at the DA and blurted out "This is an absolute waste of time to actually be spending on this case. I consider this case over and done with, this case is dismissed."

After 5 months or so, the nonsense is over. All I want to say is thanks for everyone's support. Granted I had to pay no money to the city I still in my mind lost because of all the time I had to take off of work. Goes to show that the county still won.
YEAH! Good job! There is actually more than meets the eye here. First, an appeals judge made a judgement really quickly, that's really good in your favor.

He now knows that there are a few rogue officers out there inciting the public over small things, and JP judges too. Secondly, he threw out the case right in front of the DA prosector standing there. The prosecutor basically got a load of shibby in his face without anything to say.

Thx. for fighting.

0.02.

Congrats man... I knew you'd pull through it... and all those nay-sayers to this post, hopefully you'll end up at an injustice like this someday and understand why we pulled for him the whole time...

I understand what you are trying to say. If the court had indeed made a finding, then yes the transcript would help your out. But the poster said that the judge simply said the case was dismissed without any further findings other than it was a waste of time.

A dismissal of case cannot be appealed. The charges have to be refiled. Judges have absolute authority on dismissals, and can summarily dismiss even the most grave charges. But, I digress, as the facts really don't seem to matter to you anyway, as you seem to have some sort of axe to grind with this community and our apparent "thumbing of our noses at the law" by flagrantly driving our street legal cars in your presence.

So far, ALL of your assertions and predictions and hopes about this have been proven wrong. Nice work, Nostradamus.

Like to make any predicitons about the stock market so I can take notes?

a dismissal case can be appealed on the grounds that case was wrongly dismissed.
