Goodbye EVO goodbye Mitsu....
Am I understanding your situation correctly? It sounds to me like (1) Two weeks after your warranty expired, you experienced brake problems; (2) the dealership had trouble fixing those problems; and (3) the dealership is expecting you to pay for the brake repairs.
I understand further that (4) The car has pretty low miles; (5) you're the original (and formerly loyal to Mitsubishi) owner; and (6) the brakes are original.
If I'm right on these points, and I were in your situation, I would be frustrated, too. After all, some dealerships will go the extra mile and give you more than you're technically entitled to. However, I also think it's not reasonable to fault the dealership for refusing to pay for brake repairs out of warranty.
Mitsubishi will not compensate them for these repairs, and they'll be out-of-pocket for them. They have no legal duty to pay for them out of their own pockets.
Or am I misunderstanding your situation? Did the problem emerge when you were still under warranty? If so, under typical consumer protection law (I could look it up), the warranty should apply until the problem is resolved.

Actually the brake problems were reported twice before the warranty ended and the dealership mis-diagnosed it then. The problem worsened. The dealership and Mitsu then basically threw expensive parts at the car (that they expected me to pay for) until they guessed the right part. Ultimately the part that fixed it was a part I was asking them to simply do the service manual diagnostic procedure on from the start---this diagnostic procedure was ONLY done on day 8. In the end I only asked that they pay for the part that fixed it and the part that was broken all along.
Other than that you are correct.

The car may be fine but the potential for expense is just too high for my comfort zone....and it seemed like a good time to $ell the car...and it was.
I guess I knew there would be at least one guy who'd take offense to me posting this...too bad. There are plenty of fun cars that are reliable and have a good warranty. Every car I've owned on the street and on the track has been a blast to drive but I doubt you'll find a Kia in my driveway anytime soon.

Ever took a BMW or Porsche into the dealership for a simple oilchange? Bet you can't get out for anything less than $90...
Don't complain about replacement tire prices. You can buy junkers if you want for $100/each; but you'd be missing the point of owning the car with reduced performance and handling. Like those that run 87 octane to 'save money'; ya bought the wrong car. And no, I didn't read your thread, just my .02 after owning 2 high-performance Mitsu/Subie's.

remember the evo is a new car especially to the dealers. I bet the service technician never replaced a brembo brake before much worse even try to diagnose one. It is the dealership fault for the wrong diagnosis, unfortunately even if mitsu offered to pay for all those parts, if the service cannot fix it, nothing can they do more. just had my first oil change too at the local dealer. what a difference, the lexus service is pure high end, the honda dealer is close to it and when I went to the mitsu dealer, the building was old but I know the service advisor/tech and he does a good job. I am happy! plus they were all excited when they saw my 06 MR

The Evo has been paid off for years and with the good deal I got with the R32 and the Evo sale I have no payment now either so it's an even trade essentially for a newer car still under warranty.
Yes I like fun cars and they will always be expensive cars to fix. I guess the trick with these cars is to not own them out of warranty. I actually do have access to OUR race shop mechanics. Trouble is many things are dealer only or you void the warranty....and please lets not start the Magnussen Moss warranty debate here again.
I agree the dealership mis-diagnosed the problem and then they and Mitsu refused to make it right. In the end they saved $500 but lost a customer. Sad but true.

Personally, I am a diehard EVO fan ... have always been one, will continue to be one ... I couldn't get rid of it for anything that is a step down in performance but thats just me ... It is by far the best daily driver car I have ever driven. To each his own

My wife has a WRX so that was out. I tried out a few STI's but I wasn't crazy about the feel or the lack of a sunroof and I thought that would lead into the same expense mess.
I tried out a Mazdaspeed 6 and it was OK but hard to find, I wanted to see what the new BMW 335 would be like but it's too early for that. I had an opportunity to try out a friends car and I loved it. I also got lucky enough to find one at a great price and in my color.......WHAT is it you say....

I seriously busted out laughing at work. Funny stuff...Anyway, you should have got a Volvo S60 R.
Having had and still have VW/Audi (since 1990's) and now having had 2 Mitu's (since 03). I dealt with warranty defects, etc. on both makes. I'd rather deal with VW/Audi dealers and VWofA as opposed to to Mitsu dealers and MMNA. There are of course better companies as warranty\service goes, but Mitsubishi is at the bottom of my list (at least based on my personal experience).
Sounds more like your Dealer doesn't know what they are doing. Why don't you just find another dealer, or since you are out of warranty, find a good independent.
Hate to say it, but all 4 brakes dragging, it's fluid not retuning after pressing the pedal.
IE master not working properly, or some one tried to adjust the brake pedal. Since it's a 4ch brake system, there's no way one caliper can cause the others to stick. If the ABS pump was stuck it would throw a code, or be cycling.
It's basic mechanics 101.

Yeah this really backs up my major point of not owning an Evo unless you can fix it yourself... A $30 master rebuild kit would likely have solved all your problems in less than an hour.
Warranties are only useful if you trust your car to the dealer... I don't. I will get them to pay for a part, but I would NEVER let them touch my car.

I can drive an R32 or my Evo anytime I want. I miss my car after about 2 days because the stock suspension on the R handles like a boat.
Did you ever think to go to a different dealership? Or are they the only one for like 50miles?
