valet put my evo into a tree
I would not take the car back. I would want a new evo and would do evrything and anything in my power to get a new one. YOu did not give them a busted evo so they should not let you keep a busted evo. I don't care what anyone says your ride will never be the same. Tell them you want a new one no if ands or buts, and that you are already in contact with a lawyer. Tell him he can junk your evo to help pay for your new one.
No dont blow the H3 up just drive it around in 1st gear a whole bunch, make sure you take it off roading, maybe some attempts at the world record for fastest speed over a sequence of speed bumps, maybe some winter weather testing? Just get your moneys worth out of that H3, trust me you will feel much better afterwards.

umm i wouldnt mess with the h3, talk about throwing away your chances to do anything legal wise...plus you come out looking like an immature kid with an evo.....just what this board needs more of... talk to your lawyer and take his advice...........anyways thats my 2 cents...

Messing with the H3 might not be right, but was the initial action?

Hell yeah, get a lawyer bro. You just lost a whole lot of money on resale if it ever came down to that. Their insurance will not only pay for the damages but will also give you extra money for the drop in resale value. You only have to ask...
