with this in mind seeing as that today was sunday... a police report has been filed, my insurance agency has be allerted as well as a laywer and i am consulting with a close family freind who just so happens to own a valet parking company in mass. the car goes to the shop tomorrow as i have stated, and i will seek legal action from there. i am giving them the benifit of a doubt. and driving his car because there was no way for me to get a loaner at 4am on a sunday. i get a real loaner car tomorrow, paid for by him, which is a start.

now i get a call from him. he wants to avoid insurance if at all possible. understandable, but sure as sh*t not going to happen. i will have this guy by the ***** by the time i am done with him. if the damage isnt as severe as it seems, the car will be repaied. if it is in fact totalled, i see a black evo IX mr in my future

You might want to go back and delete the post about launching his Hummer to avoid more BS.

There's nothing to sue for. This is why we have auto insurance. Make sure the police report documents that the valet crashed the car. Make sure there are statements from the valet and his boss admitting to what happened in the police report. File a claim with your insurance company. If they want to recover some of the money they spent in repairing or replacing your car then their lawyers will go after the valet. There was no theft, you handed your keys over willingly to the valet. It doesn't mean that he had the right to abuse and crash it but it means the car wasn't stolen.

If your car is repaired instead of replaced then you need to demand your insurance reimburse you for lost value as well as for the actual repairs.

I agree with you on all counts except he should file a claim with THEIR insurance company. No need to involve his at this point.

how can you crash into a tree on delaware ave. I didnt even know there where trees. Also you would have to be going pretty fast to do that on a big street like that. How far is the actual valet company from the place of the accident...I think if it was far or out of the way of the parking structure you can argue that he was going for a joyride. You shouldnt have said that you want a new clutch and flywheel out of this becasue it makes it seem like blackmail....you could have just included it into the price of suing them.
