valet put my evo into a tree

On my 06 Ralliart - Hit black ice and damaged front right panel and rocker arm dam. They basically have to repaint the entire right side because its Pearl White. Cost to repair $3,000.00.

Just to give you an idea half of it is labour.

Good luck with everything on this man. I love that area of Philly, I've been up there a few times to see concerts @ Electric Factory and whatever that place is by Market Street. This really should become a lesson and example for Valets that it's just not acceptable. Like everyone said, the reason you use a valet is so you don't have to leave your car on the street or unattended...

I understand what your going through. A drunk lady ran right into the door behind where i sit. And she wasn't driving if you know what i mean and shes trying to sue me. And my insurance is probably going up. For something that wasn't even my fault.

thats almost as bad as when a guy that ran a stop sign and hit my mom's car tried to sue her for injuries he had even though he flew past trying to brake and hit her ofcourse it happend in philly

This thread is pissin me off. I hate stories like this. I wanna take your position and beat the shi* out the valet guy. As immature as it sounds, I wouldnt like my personal property to be damaged especially something like a 30k car. Post up pics so we can give you an idea whether it is totaled or not. Good luck with everything, and I hope you grab this guy by the ***** and get everything you need...and if you need a new IX, you better have one picked out already.

I definately disagree with that spectre.... Yes, he handed the keys over willingly, but that was for the area owned by that company. It is in their posession inside the valet area, once it leaves the property, it is no longer in their posession, even if it isn't in the owners. I mean, if your girl gives you the keys to her place, and asks you to watch over the house while she goes out for a bit, does that give you the right to take her stuff? No. That classifies as theft. And as far as I am concerned, that is what this is. He gave them permission to watch his car, in full confidence that it would be taken care of while he enjoyed his night. If the accident was on the company property, I would be agreeing with you and say that the theft charge would not hold up, but since this accident happened outside of the confines of the business, it means that it was taken without consent, which in turn makes it theft. Every Valet has to turn in the keys to the vehicle into a centralized lock box area, and from what I understand, once you give over your keys, you are essentially giving the owner of the Valet company the keys, to be locked up and stored almost like a storage unit rental. So at very least, it was stolen from the company. Still a theft charge in my eyes. But that doesn't mean that the owner of the Valet company is the victim in this case. As far as I am concerned with that, there should have been no way that the car should have been able to leave the site without the owner taking it off site, let alone returning in the state it came back in. If Valets are there for every car that comes in the lot, then how could this one car come back in un-noticed by the on duty manager? It was his responsibility to make sure no cars left the lot, and it was his responsibility to report all of it as soon as it happened. So that makes 2 people that neglected their job duties. The Valet, and his Manager. I do have to admit I am VERY impressed with jjm4life, be it me in that situation, even with my ES, I would have taken the price out of his ***. He did the right thing in refraining from anything that would damage his case against them. I don't know how he did it.... But as a note to jjm4life, we all have varying ideas on what to do in this situation. We can't tell you what to do, only advise you of what we would do. Spectre, while very knowledgeable in what could happen with this, I feel is wrong about the fact of persuing prosecution. The fact that the valet had your keys, yes usually causes a bit of a rucus in the law sense, because if I were to crash my friends car, the cops would say to him, "You gave him permission to drive the vehicle", but this case is completely different. You gave the Valet, and the Valet company permission to PARK the vehicle. Period, End of it. What he did, was take your property off the company property, essentially making it theft. True there was a consentual agreement, but just because your girlfriend gives you permission to have sex with her, doesn't give you the right to shove it up her butt now does it? You gave them permission to park it, not drive it. And as the saying goes, drive it like you stole it, and that valet did. Case closed. My advice to you, is to let your lawyer go nuts on them. Spectre's advice is to go through insurance. I ask why go through your insurance if you didn't have anything to do with the damage? We pay insurance on cars to make sure we protect ourselves...But any claim we file goes against us, and makes us higher risk. Why do that when you didn't do anything? Just my 0.02 (Well, 0.0175, I live in Canada after all) HOPEFULLY everything gets taken care of quickly and to your benefit, and as for the comments posted on here about the H3 being trashed, don't worry about it..... 1st amendment right is a beautiful thing. The internet is a perfect example of free speech at it's finest, and cannot be held up in court, especially since the H3 got back to him in the condition it left his posession..... Now if you trashed it on him, I bet he wouldn't be so "Don't call the insurance" and prosecute with all his power. I figure at very least, they need to find you a used EVO of the same year, and if they cant, well, that's their problem now, isn't it?
