Cars are never the same after an accident. Back in 1997 some guy hit the front left corner of my 1995 RX7 twin turbo. It need a new fender, pop-up headlight cover and bumper. About $2,500 worth of damage. Blue book on my car at that time was $37,000. I fought with AAA insurance for 3 months and after all the drama they kept the car and gave me a check for $42,000. Because i found an exact replacement that cost $42,000 at marin mazda. So yes its possible that you can get the car replaced.
In all seriousness, you need to sue them for all that they're worth if the option is still available to you. The valet owner, the employee, and his parents if he's a young kid, which I'm assuming he is.

I agree...good thing you filed a police rpt. (sorry for the LAPD abbreviations!) The car was definatley "drifted" into the tree. PERIOD. As for a stolen veh rpt, it won't stand...you gave him the keys, and responsibilty of the car...(possesion is 9/10th's of the law). You need to ntfy your insurance co, AND GET A RENTAL CAR NOW!!!! The longer you drive his H3, the longer he has for saying you F'*&$ed up his H3. Don't trust him, no matter how nice he was/is. I am not trying to rub salt into a wound here, but it's the "one in a million chance" such as yours that prevents a valet from driving my car. Good luck with evertything man.... I truly feel for you..
From the way it sounds, and how laws are here in the frozen north, yes, you gave them control over the vehicle, but that is only for an area where they are insured and responsible for damages. Once that little shyte took the car off the lot, he was no longer an employee of the Valet service, and basically just another guy. Once it left the lot, even though he had your keys, he was not authorized for use of your vehicle on public roads, therefore I firmly beleive that can be classified as theft. Then the little a$$wipe goes and wraps your sexy beast around a tree, thus making it an accident (Id go for battery or murder charges depending on how bad the damage is AKA write off, but that's just me...) the accident would be bad enough to the cops, but once again, the rocket scientist decides to leave the scene of an accident, another criminal offence punishable by law, THEN good ol einstien returns to the Valet and parks it, as if nobody will notice? WTF? I mean, a minor 1 inch scratch, he could try and say that you wouldn't notice, but to do that, then park it back there? Someone should drain his gene pool, cuz we don't need the risk of him actually procreating.....
But to sum it up, I firmly beleive that the Valet service should get you a new ride, due to the depreciation of the car because the title is not clean, the car itself will not perform as well as it should, and even if you wanted to sell, no one would buy a salvage title car for near what your car would be worth.... so they should at least find you another EVO the same as yours plus the little shyte should be fired, and face the following charges:
Theft
Wreckless Driving
Fleeing the scene of an accident
Purgery (Because we all know the a$$wipe was 'smart' enough to try and deny the whole incident)
and driving without proper insurance
As well as face all the charges of the damage to the property that he had caused.

Call up Shapiro and Cochran, I am sure by the time they are done, you will have a fleet of EVO's porsches, skylines and veyrons that would make OJ proud. Give them hell man.... get what's yours.

I am not trying to argue the law....let me give you an example.... This goes to the area where a car is being operated by somone other than the owner (consensually speaking). If you drop off your car at a shop to be repaired, they wreck it on a city street during a test drive. That is a business dispute, not a theft. When you valet a car, you don't sign anything that says the car can, OR cannot be driven off the property. The definition of stolen/theft is "removing property that is known not to be yours, without the owners consent". If ANY part of those crime elements are not met, there is no officical crime. He GAVE him the keys during a "business transaction"....he had owners consent to operate the veh. He went beyond the scope of his duties, yes. BUT it began with consent.
Personally, if I wasn't a cop, I would ask for the valet's consent to break his jaw, and have a one night stand with his sister!

mike@forge you make a lot of valid points. by no means am i taking this lightly and an h3 is def. not my idea of a cool ride.
with this in mind seeing as that today was sunday... a police report has been filed, my insurance agency has be allerted as well as a laywer and i am consulting with a close family freind who just so happens to own a valet parking company in mass. the car goes to the shop tomorrow as i have stated, and i will seek legal action from there. i am giving them the benifit of a doubt. and driving his car because there was no way for me to get a loaner at 4am on a sunday. i get a real loaner car tomorrow, paid for by him, which is a start.
now i get a call from him. he wants to avoid insurance if at all possible. understandable, but sure as sh*t not going to happen. i will have this guy by the ***** by the time i am done with him. if the damage isnt as severe as it seems, the car will be repaied. if it is in fact totalled, i see a black evo IX mr in my future

sorry to hear that man. I hate too add fuel to the fire, but I too know a couple people that have been valets. They all beat on fast cars quite a bit. It really is sad because you pay them to take care of it..... but that's the world we live in.
As for the legal scene, you are on the right track. Keep everything detailed from pics, to estimates, statements, and where in fact the accident occured. With proper legal assistance from your lawyer, I am confident you'll be ok. I hope your evo gets replaced and you stick it to them on this one.
