Mits is WATCHING US at the track!
Hello from Tokyo (last day, off to Taiwan tonight). Had way too much windshield time, but have not seen a single EVO! A couple of GT-R's, one STi and gazzillion '03SL500's, but not one EVO...
Anyway, I am not a lawyer but deal with contract issues including warranty clauses almost weekly 'cause of my vocation. As such I also have access to an inhouse legal council specializing in contract law. So, for all it's worth - I do not remember that warranty was spelled out, including the "do not race" clause, in the Purchase Contract (PC). When I get back I'll also have to check if fine print on the PC states that undersigned agrees to terms and conditions of the Mitsu Warranty. Or, if somebody else can check I'd greatly appreciate it - suspense is killing me ;-)
If neither is true - ie you did not expressely sign for the warranty, then it is not worth the paper it is printed on - Okay, it is worth something to a corp lawyer to make your life miserable, but not to the judge. #1 - It is not legally binding if you did not sign for it 'cause you are not legally required to read warranty brochure and therefore you may not have been aware of the "do not race" clause before you took the vehicle to the track. #2 - If there is no clause in the PC that makes Mitsu warranty binding, then you are covered under UCC (universal commercial code) which is open to wide interpretation.
Disclaimer: As I said before - I firmly agree that if YOU broke it, YOU fix it! But denying warranty on the parts when used as intended and flat out denyng warranty on parts completely unrelated to racing is utter bunk!

I'm willing to bet it ended up on the show room floor after this event as new. I wrote down the serial number.
And yes it was an STi:

Can we say illegal use of dealer tags?

Changing the tags is ILLEGAL, all he needs is a pic of the car with the license plate showing. Why don't you try using a license plate off another car, have a cop pull you over, and see what happens.
But they are doing nothing wrong by racing the car. It's their car; they can do what they want with it. It sucks that they are being hypocrites about it, but I'm not sure there's much to be done about that.
If you make it clear to Mitsu Corporate that average citizens like you are getting warranty-screwed for racing their cars, while the very dealers who say "you can't do that" are ALSO taking their cars out and racing them (you can bet their cars are still getting warranty coverage)...well, then, maybe someone who cares will hear you.
But honestly, I doubt it.

We were told from our district rep that any repair over $500 will throw a red flag... meaning we have to ask the rep if we can service the vehicle or not..
Basically if you bring your EVO into the dealership for a clutch problem.. since it's over $500 for the repair... we have to call the rep and tell them info about your car.. he then determains if he wants to send someone out to look at it or not.. if we do replace a part we have to send the damaged part in to be "investigated"...
With every race car there are parts to be broken... that's why Mitsu has to be strict on the Warrenty situation... they know people will race the car.. and they built the car to do so and hold up as best as possible.. but you can't keep from breaking crap.. especially with mods that Mitsu knew people would come out with.

That's absurd. Any service at dealership sort of check the tire pressure is over $500. And dealerships can't even check tire pressure right when delivering an Evo.
That is a just a great way to **** of customers. The Evo managed to get a low of Non Mitsu customers to give them a try, to bad their pissing that away in the wind. So many BMW, Toyota, Ford, Subaru folks have opted for an Evo, but how many of them will not ever get another becuase Mitsu is so shortsighted?
I hope Mitsu puts it's glasses on quick before it walks off a financial cliff..

Use your head! Would GM or Ford or any car company warrenty their cars that were raced and broke as a result? Nope.
Stop griping. You know the cars are fast and you know that as soon as you start abusing the car something MAY give like the clutch or transmission. Yet you still drag race the car that WASN'T designed for drag racing.
You may want to re-consider what you do with the car that's considered fun.

Actually...they would. I have a friend who just had both his half shafts replaced that he broke at the track. I know several guys who have gotten warranty work done on their 03 Cobras as a result of racing. It does not say in their owners manual that racing the car will void the warranty like ours does.
I love my evo, but I was sooo close to buying a z06 for these vary reasons...check the vette forums, gm is very good about replacing parts broken during racing. Its a dont ask, dont tell policy...
I wouldnt' say you made the wrong choice. In the 4 door performance sedan category, the Evo is tops especailly since it's < $30k. Under $20k, there is the SRT4. THe RX8 is a bit underpowered and over 33k once you get the same standard evo features on the RX8, HIDs, etc. In the overall highest performance car, you've got the Enzo and Gallardo and such. For the bang for the buck, performance only the Z06 is tops. But it still has low quality GM interior, a 20 year old shifter that just feels unimproved. Both are great cars. But if you are looking for 4 doors, you can't go wrong with the Evo. If you're looking for all out performance, 2 extra doors is extra weight, and often a higher CG, etc, so have historically fallen behind the 2 door coupes.
Comparing Apples to Oranges.
The under $30K mega sport sedan test pitting 12 cars against each other was one of the best comparisions of the category the Evo falls in. It doesn't offer luxury, but it can't be touched performance wise, though the G35 gets very very close with it's sweet 3.5L.
