actually the bill is very solidly founded in constitutional powers, and several appellate courts (minus virginia) have already ruled in favor in of it.
the misunderstanding with most people is that the health care law requires coverage. now this is a little nuance, but what politics isn't.
it doesn't *technically* require an individual to have coverage. it just gives you a tax break if you do. if you choose not to have coverage then you do not receive the tax credit.
that is WELL within the powers of congress and rather clever.
