i doubt it. even with the conservative bias of SCOTUS at the present time i'm confident this one is going to stick.

again, you're not forcing someone to engage in commerce. there is absolutely nothing about in there. you're rewarding people who do choose to engage. you might call it semantics, but that's what legality is.

think of this along the lines of child tax credit, because conceptually it's very similar. there is a tax on everyone, but one to gain exemption from it.

In terms of the penalty aspect. Here are at least 4 examples saying YES there is a penalty for not buying insurance. None of which I would consider a "conservative" outlet.
