I am so glad that you were not on that major Highway otherwise we all may be talking about something else on here but I am very glad that you not seriously hurt....

Ok I know laws from one country to another and even state to state are different... what you probably are already aware of is that your car is still under manufactures warranty... so there is no point here in them(Mitsubishi) trying to quote you cost figures when they start doing this then you need to be very firm and declare to them that this is a car warranty job not an insurance job - then you also talk to your insurance people and tell them that they(Mitsubishi) are wanting for the repairs to be an insurance job not a new car factory warranty job... insurance companies do not like to pay out on claims and this appears to be a clear cut case of Mitsubishi not accepting there responsibility for a possible mass national recall of this car... this is why Mitsubishi are wanting it to be covered by insurance so that it does not have to be declared as a fault in there product which could inevietably cost them $100,000's of dollars... this is why they are telling you quotes and prices... now your insurance company does not want to be paying out on this so they should be wanting to help protect there possible payment of what is being quoted and should be there to help protect you the policy holder and the car insured... my suggestion is to make an appointment with the insurance company (not nessicarily the assessor he is basicly a contractor to get the best deal for the insurance company not what is best for the policy holder) and talk to them about what is happening and get there advise then if this is still not working out then there must be a group or governing body that allows people to make complaints about fair trading

hope that it all gets sorted out very soon for you but you don't have to accept a descission that you are not happy with just remember the car is still under factory warranty and they must honour this agreement that they have taken out with you when you signed the sold papers and you handed over the money

Day 10: Mitsubishi corp. forgot to sign my case to somebody. YAY!! We will be contacting my insurance later to see if the mechanic has been to look at it.

Ok, Mitsu Corp is on the case, as is my insurance. Updates for sure comming soon, will hopefully have good news by the end of the week.

Success!! almost.. My insurance company's mechanic that they hired finished inspecting the car. He deemed that the Rack and Pinion steering was the point of failure. Mitsu has agreed to cover it under warrenty. Only problem is..... They want to try to fix it!!! ahhhh!!! The body shop manager did not re-inspect the damage so they are still at the $5300 quote. They will be putting it on a lift tomarrow, and hopefully I will have a loaner vehicle. I will be talking to Mitsu and the dealership about the option of them doing a buy back of my vehicle. I will keep you guys updated through the progress.

If it was me I would play the "I don't feel safe in this car anymore" card. There is no way you should have that repaired.

I would tell them absolutely under no circumstance will you accept a repaired vehicle. A warranty issue doesn't bring down the value of the car, but an accident does. Especially a "major" accident, which if the starting estimate is already 5300 this is definitely in that category.

I would tell them they can either buy the car back (original value) and let you purchase something else or to give you a brand new RA, any model year since your is an '04. IIRC you purchased new so this is not an unreasonable cost for the dealer considering the circumstances.

I would also be prepared to ask for a large sum of money in depreciation value if you wanted to go another route. Somewhere in the neighborhood of $5000 and having them fix the car. Insurance companies sometimes pay depreciation values on some vehicles (when you aren't at fault and at least in my state) so I am certain Mitsu would be willing to if you pressed the issue.

The very serious failure point is grounds for a lawyer to be involved, even if they satisfy you 95%. A lawyer will help you greatly in this matter, especially now that Mitsu has accepted fault and a third party has attributed the accident to a failure in the steering.

No matter what you decide I hope to see you on the boards still.

Would you have to be very carefull when asking for a buy back because they could also say average market value for the car is only $??? so you could stand to lose out again I would not personally settle for anything less than a full replacement car.

They say that it had a point of failure does that determin that there may be other points of failure as well within this car... again back to full replacement.... as AdamRA puts it you don't feel safe in the car anymore

As for getting a lawyer I don't know how much they cost but the cost of a laywer could cost more than the car itself or possible outcome so be carefull there

Good luck with it all best advice is to stay calm and firm on what it is that you are wanting when talking to these people

cost of a lawyer in a case like this would actually be on contingency. If they don't win they don't pay the lawyer anything. If Mitsu were to settle or lose in court then the lawyer gets a % of the winnings.

woohoo I just got a free rental car!

Its a 2007 Ford Taurus v6 with like 15,000 miles on it. And it doesn't smell like dead bodies inside either!

It is black with red pin striping. Almost worthy of show and shine.

About time they gave you a rental car.








...and why is it they all seem to end up smelling bad? I had a rental Jeep last year out in California that only had 3000 miles on it, but I had to drive it around with the windows down the whole weekend.

lol one time when my mom's camaro was in the shop the rental that they gave us had dried puke in the back seat. Talk about sick!
