UPDATED Wing ticket
actually, what the us dot says goes, the states CAN NOT override what they say. now, the states CAN make the laws harder, but CAN NOT OVERIDE the feds. now, since the us goverment says the wings ok, the state must say that its ok. the state cant pass a law making it illegal to have the wing if the feds say its ok... like it or not, thats the rule. because if this was allowed, hell, im sure wed all be in anarchy now as it is.
"
http://www.fact-index.com/s/st/state_court.html <-- taken right from there. fed law OVERRIDES STATE LAW, u cant disprove that moron
"
The relationship between state courts and federal courts is quite complicated. Although the federal Constitution and federal laws override state laws, it is not the case that state courts are subordinate to federal courts, rather they are more accurately two sets of parallel courts. With regard to an interpretation of a state law, all Federal courts must defer to the interpretation of the state courts. A case can be moved from a state court to a Federal court only under two conditions. The first is if the case involves federal law or the U.S. Constitution. The second is if the case is between persons of different states. In the latter case, a litigant can bring a matter either to state court or federal court, and deciding on the jurisdiction is part of litigation strategy."
The EVO is 50 state legal, not just emissions but everything. that includes the CF Wing, the HID's, the whole nine yards. So I agree with the rest of the guys on here, he needs to appeal the courts decision, get the newspapers and the TV news stations involved.
as everyone else has said what about Trucks and vans, Ambulances and Fire trucks and so on and so on, it is an unfair justice system, it needs to be corrected otherwise he will be the prime example with more people getting stung with this crap.
The cop and the judge in this case do not have a leg to stand on, and need to be punished for abuse of their power.

The Wing is fully functional, it does serve a purpose, as other people have said just cause you don't like the wing doesn't mean you have the right to spoil it for everyone else, People like you spoil it for the rest, you're probably the type of person who would go to a strip club and complain afterwards that it was indecent exposure, well all I got to say is this, you know what goes on in a STRIP club, if it is going to upset you then don't go in and mind your own business, you are also the same person who complains to the censorship commitee for TV programs (FCC)
that show sexual themes, or excessive violence etc, when all you have to do is change the channel, just cause you don't like it, don't spoil it for others,
MIND YOUR OWN BUSINESS!

It's hard to have trust in someone who not only knows nothing about the law, but has such horrific grammar and spelling abilities. States can vary on emissions and noise standards but not on any other automotive standard (i.e. minimum bumper requirement, angle/brightness of lights) which are the direct responsibility of the D.O.T. No state can impose a more rigid interpretation. Those are the facts. With proper documentation and representation this case will be overturned.

Your opinion has no merit on here, so why bother posting?

You'll be saying that it is illegal for aircraft to have wings next.
they have a function, don't they?
What about the wings on Womens panty liners, Don't they have a function?
What about the big **** off antennas the cops have on their cars, aren't they a rearward obstruction.

I am glad that police and court finally start ticketing those that have those wings on there cars, hopefully more people will get the message take them off or get a fine. Local cities/states/counties can make there own laws that makes things illegal regarless if federal goverment makes it legal. All it means that you will not be prosecuted by federal goverment but because you broke the law of state/city/country you will be prosecuted by them if they want.
Wow, who is this tool? I am afraid there might be more to this story than we know. Someone just does not come on a forum and starts something like this KNOWING that they are going to get burned. Either way, lets wait and see what happens with his appeal, then we can all get back to his comment.
