Here's the good advise:

You will win on appeal with any decent attorney and the proper documentation... then you might look at recovering some damages... not from the local govt, but from the Judge as an INDIVIDUAL. Try to remember that it is the Cop's job to write the citation, but it is the Judges job to deem it lawful and enforce it.

On a side note, I should have stayed a thug as a young man since all you brilliant individuals are working so hard to keep the Police out of the way.

 

Yeh, that's a fairely big civil issue, if you're trying to fight the judge.

I love how you twist the words zeus, I don't think everyone is out to get the cops off the streets. I think tickets like that are just another way the county is making money off illegally, especially when the county has a low rate of crime, and they have to ticket you on anything to make their quota.

One Atlanta Sergent Told me that cops in atlanta don't care about small crap like that because they're too busy getting calls about murders and violence.

But cops in the suburbs have to ticket you this way, because they have limited funds, and they have to meet a monthly ticket quota. Also, they really don't have anything important to do, so they have to pick on someone. But they can't pick on someone with a normal stock car, they have to pick on someone who's a bit different, just like the dealers.

The county is ran like a business and I think its BS when they go over the line of what's a fair ticket and BS ticket to fill their quota, because they're saying all the import people are the same and judges will see them as thugs or trouble maker and give them a ticket anyway without even knowing anything about the cars.

How many judges know what's legal and what's not legal on a car? If they see a big huge wing and the cop says that's blocking their view of driving, the judges gonna think it's illegal and abnormal and give you a verdict that's not in your favor.

It's going along with the general perspective on import tuners on societies eyes and its wrong.

 

Just because its legal in most of the United States doesn't mean it has to be legal in Milwaukee. Its a regional thing. Lifes not fair, deal with it.

 

This is just a bunch of bull****. I suggest you appeal this cuz that judge must have been on crack. Must be a racist policeman and judge to give this kind of a judgement. Must have gone back to his office and had a good laugh...F*CK HIM

Did you read what others have posted? The federal government approved the car as it is sold. Meaning that everything complies with the laws of the transportation department. Local and state governments cannot override those laws.

 

I would sue also because the "obstruction of vision" is subjective. Meaning, if you're 5'4" the wing may be and obstruction. How about if your 6'6" if wouldn't be an obstruction. They are saying like if your not tall enough, you can't drive this car with the big wing. Fight it!!!!!!

I agree 100% I'm sick of the corrupt court system we have. Officials are just simply getting greedy with overcharging tickets and then adding court fees. It is complete bs. And they knew that they could get away with charging you $360 for your stock wing because they figure that your not going to spend your time and money to fight it. You can thank the left wing *******s in our state's and national senate for this. Don't even pay that ****.

 

Life is not always fair, but thankful we do have a democracy such that when the legal system is wrong there are means to overturn the decision. I may have this confused with the the whale tail case where the ticket was actually posted, but did the original citation designate a specific statute you were in violation of? I searched long and hard through Wisconsin penal code to find such a citation, but could not. There may be such a law on the books there and elsewhere but then how are moving vans, even lamborgini countach (0 rear visibility) legal on the streets as per the D.O.T? Good luck and we are all pulling for this wrong to be righted.

 

yeah, that ticket is definate BS. Look at a stock harley davidson. the exhaust on those bikes probably reach 110-120db's, but since is come from the manufacture that way it's legal. If the car is dot approved. the local or state gov can't do sh*t about it legally. You've definatly been A$$ !@#$%^ w/ out proper lube. I would spend every last penny I had to beat that. then when you know your gonna win. get yourself a little extra money for the mental pain and suffering. Stress is a killer. I would go in the court room twitchin and stuff and say you had a nerves break down or something. **** like that happens to me when I get real upset about things((I have anger problems)). I have gone through this whole post and here is what i think. The best thing is too ask for a jury trial. 2'nd, take pictures THROUGH THE VEHICLE to show that there is no obstruction. Make sure you are creative in camera angles and if you have tint, roll down all the windows. You should also bring pictures of stock cars with large wings. i.e. Plymouth super bird, integra type r, sti etc. also take in any documentation on mitsubishi letterhead, make sure original, not copies. good luck in your dilema. p.s. I doubt that sema will help, since it is not an aftermarket part.
