If the initial reason you were pulled over was for headlights ...... and they are stock ...... then the entire write up will be tossed out by the judge.

I'd say 80% of the people on this forum have cars that wouldn't pass a smog test.

I would be very careful offering this advice....CA MV law is very biased towards the 'perceptions' of the Officer, and the courts have a habit of siding with them. It is not always true that if the initial citation proves to be invalid that the entire case is thrown out. If the Officer made a citation based on 'good faith', and discovered other violations, it may be upheld on the actual violations. Proceed with caution with the above idea. I think the whole thing is rediculous and CA laws are entirely too picky and unreasonable, but it is what it is.

I agree... First off, having a plate that says "8 UR V8" isn't illeagal, and is NOT grounds to conduct a traffic stop, which is what you stated he said. 95% of traffic stops are recorded as well, so if you're sure that's what he said, ask for the tape. That alone should be enough to get your ticket dismissed. If they give you a hard time about the headlights, as long as they are 100% OEM (no upgraded bulbs or anything), there would be no reason for the stop and anything discovered subsequent to that should be dismissed.

I am in no way a lawyer and don't live in Cali, but pops was a cop and helped me out of more than a couple of these BS tickets... Good luck, man

Question...well they plug into the OBDII port??? Reason for the question is I'm in the same delema where I have to go to the state ref and I have my creader plugged up in my OBDII port. I just don't want it hooked up and the ref goes and plugs into it and sees the creader. Might make him suspicious.

even with all ******* cops i still think cali is the best state for cars.
nothing beats a cruise down Topanga or Latigo canyon to PCH on a saturday afternoon....

Nope, I got the ticket in Oceanside. Temecula Cops are awesome, I never got a ticket there. Oceanside has drug and gang issues, but the cops would rather waste our tax dollars spending 45 minutes giving a ticket to a guy with a modified car. Efficiency at its finest.

Hey there...FWIW I am a cop in So Cal...LA to be exact... First, if the cop pulled you over because of your lic plate...thats illegal, and infrindges on your civil rights. Two, NOT many cops in cali record their traf stops.. Unless he WROTE ON THE TICKET his P.C. (probable cause) for the traf stop being the license plate...he WIL DENY IT. HE will say it was for the decibel level of the exhaust. AS for the headlights...no brainer, bring in the color pamphlet from Mitsu showing the factory headlights. NOW, as for the smog referee....he is ONLY supposed to check for CARB EO numbers for the aftermarket parts to see if they are smog legal. If you can scan both sides of your cite and email it to me, I will give you more accurate advice...PM me if you want me to help ya. POINT IS... police are given DISCRETION on the grey areas of the vehicle codes...such as exhaust systems...I do not, nor will I probably ever carry a decible meter in my black and white. It's easy to fix and beat your ticket...Temecula is just a little more conservative than the average dept...as for that officer?....CHANCES ARE HE DRIVES A HONDA S2000 AND GOT SPANKED BY AN EVO ON THE WAY TO HIS STATION THAT DAY!

I'll take the risk of being a 1 in a 1000+ chance to be pulled over in order to have the perfect 75-85 degree weather year around. East Coast....No thanks LOL. Give it another month when it starts snowing and then say that.

Make sure you keep us updated on the outcome. I'm sure once you pass visual, smog will pass since there are no AWD rollers

I appreciate your offer, and I will scan it within the week. When I do, I will PM you to get your email. The VC's he cited me on are: 25950(A), 27150(A), and 27156(B). The last one is the one that requires I go to the referee, and he wrote non-correctable. By the way, I was in no way generalizing about cops, just this particular one was pretty un-reasonable.
