Sorry for the delay...

well, last week got a call from the dealership to take more pics of the trunk...guy at the dealer took a couple more pics along with pics of my vin from the windshield and from the door...other than that dealer didn't have much info to offer except to just wait a couple days - it's been almost a week so, i'm def going to be calling first thing monday...

Same thing is just starting to happen on my evo. I pulled my wing of though and found it. The spot wasn't very big but it's in the exact same spot your is coming from. It's about the size of an eraser head and it's rust coming from BENEATH the paint. I brought it to the dealer and they took pictures of it to send to corporate. I was a bit embarrased bringing it in because the spot is so small but rust is rust. If I did not catch it early it would get as big as yours has become. Since then I have I used some rubbing compund to get some of the rust off which didn't help that much but I also covered it in touch up paint and claercoat, then I put the wing back on. It has been a month now and they have still not got back to me so I don't think they'll cover it.

are you sure its not rail dust from being transfered on a train? happened to my S2000 and had to use a claybar to get if off.

I had the same thing under my wing (03). A small eraser size spot on one side.. and a larger half dollar size spot on the other side. Good luck!

Warranty Issues <Mega Merge>

To make story short. I bought a new Evo IX from Southcoast Mitsubishi. When I took delievery via (west coast to east coast shipment), the car had 60 miles on it.

Car was bone stock
1) I got the car with bad/worn 2nd gear synchro, it would grind. Local dealership replaced 2nd gear synchro under warranty. But the tranny never felt right, even after repair. 4th gear would randomly pop out of gear during criusing.

Car is still stock and 500 miles later
2) Whiny noise coming from drivetrain, so took it in and they replaced transfer case under warranty. Too many problems for a new car huh?

Car has catback exhaust, k&n drop in, and forge dv, 1000 miles later
3) 4th gear continuosly pops out of gear and wouldn't drive in 4th anymore. The car is babied and I've been cautous due to previous repairs. Honestly scared to drive it hard, just seemed so fragile.

NOW, thinking with mild mods (catback, k&n drop in, valve), I didn't even think Mitsubishi would think about denying my warranty. But sure enough, they did. Which we ALL know is total BS. They haven't given me a clear cut reason for not honoring my warranty, just to say even though it's only 10hp or so increase, it put strain on the tranny. Now with only 2k miles on the car, I am screwed. It's not fair business. i could understand if I had an aftermarket clutch in here and they denied tranny work, but a CATBACK?

I will be pursuing legal action, (under mossman-magnus act?) or pursue "lemon law". I really think I picked up a Lemon POS. Interior is starting to rattle, water leaking under storms, brakes squeaking bad, leather of Momo wheel peeling off, etc. What do you guys think I should do?

Here is where you guys can help me out, I'd be willing to paypal a small fee to those who do help me.

I want to compile a list of 10-15 guys that have had warranty work done/honored with mild bolt ons (catback, bov, k&n, maybe more). Then I can have some leverage against my case. I know you guys are out there. Help a fellow enthusiast out.

wow. i feel for you man.

i have that leather of mom wheel peeling off as well. I dont know what to do. I think they'll say my exhaust made my steering wheel to go bad.

this is on a 06 evo 9

i had my car worked on (replaced input shaft and bearings) and i had a full turbo back exhaust with hks drop in

The clear thing here though and how i looked @ it after my first bad dealership experience is i have no warranty.... they are looking for some dumb reason to void it... Basically its going to end up with you having to sink tons of money in the courts and lawyer fee's to make mitsubishi do anything... Even the nothing is going to be 100% that it will work out. Most likely the people here with mods wont vouche for it due to the fact then their warranty will be in jeopardy and im sure they will be red flagged... Personally myself mitsubishi cut a 3x4 inch hole in my bell housing to replace a clutch then Red flagged my car after they destroyed my T-case. After that a mitsubishi dealer hasnt laid a hand on my car only me myself and i...... Some how all that was standard procedure though and was cleared my mitsubishi corp.... As far as i am concerned mitsubishi can go to hell and all the dealerships can go under and i would be perfectly happy

According to law, Mitsubishi can not deny your warranty. Warranty can only be voided when modification are made in conjunction to your modification. Like if you installed coilovers and your engine blows, the coilover are not related engine failure. In your case a catback, drop in K&N filter will not lead to transmission problems.

If I were you, just take the case to a lawyer. they usually don't charge unless charge unless you won the case.

BTW car is GSR 5 speed. (I thought these were better)......

Can't go to a different dealer, the dick head service manager already took pictures of the catback, k&n filter and sent it to district warranty rep. Also I was on the phone with Mitsubishi USA fighting it for 3 days and still got denied.

That is why I have to take legal actions. If the car had 10k miles on it and was more modded, I wouldn't even pursue this, but come on, A CATBACK and 3k mileage?

The BS is that they said that the catback caused it, that's whats funny.

Tough fight.

Basically in mitsubishi's eyes any modification on the car is an act to void an entre warranty. You shouldn't have put any mods. I would take them off and get a good lawer.

My intentions exactly! The Mossman Act? (Where they have to fix it unless they can prove that the certain part caused damage?)

Does this make sense to anyone? "Catback+K&N increased horsepower therefore put more strain on the 4th gear synchro!" ???
