Glad I found this thread- If anyone can help I would appreciate it.

I bought a 2003 BBY evo w/31k on the odo. Dealer that sold it to me said it was bone-stock with the remainder of the factory warranty. On the drive home, 13 hours long, the "check engine soon' light came on. I parked it in my garage and went to sleep. Next morning when I pulled it out to wash off the 13 hours of dirt accumulated on the drive, there was a puddle of gear oil on the garage floor. I contacted the seller who said they would pay for it and took it to the local Mitsu dealer. He found a broken egr solenoid, a Zum clutch and there seems to be some discrepancy on if the car has been lowered. The leak is from a broken input shaft seal on the tranny which the dealer is now saying that they cannot tell if it's been abused or raced and the only way to see is to drop the tranny. If it turns out that tranny shows abuse, it was raced and that would void the warranty. I would have to pay for it. I said if the warranty is void, then we'll discuss how the seller would come pick it up and how I would get my stinking money back. Any suggestions? I am documenting all with a diary and I will be taking pics and video when they get it up on the lift

Thanks. I saw that post awhile ago and i think i posted something in it. very good thread though. I had forgotten about it. The local dealerships here are pretty good for the most part. Ed Voyles, who is closer to me, said they would warranty it, but only if i removed the boost controller, but they're techs arent the best. I then found out about Rick Case Mitsu and from what ive read on local forums they will warranty the car as long as it hasnt been excessively modded (larger turbo, cams most of the time, etc). Although if the engine is modded excessively and nothing else is then they will warranty your suspension, fix the calipers, fix the spoiler stuff like that.

ty for your help the dealer still has yet to get with me but I have contacted the atty gen office to see what they have to say about the whole situation and I am not going to lay down and let them take my money or my car. Dealer doesn't think it'll be voided but you never know, they play that street race card like a wild get out of jail free type.

Funny thing though, my Pop is a big-wig for Goodyear and I value his opinion, and he told me that with this many problems that I ought to just let them go ahead and take it back and refund my cash. He said and I quote "I hope they didn't try to do that drifting s**t in your car!!" HAHAHA Pops you just lost all cred

I Bought A 05' Evo Viii With 10k Miles.... One Bad Launch And My Clutch Was History...(first Awd Car).. Took It Back 3 Days After I Bought It And The Dealership Said It Was Not Going To Be Covered Because The Clutch Was A Wear And Tear Part. I Told Them That I Knew That But How The Hell Is A Clutch Going To Go Bad In Three Days.. Their Argument Was "a Technician Certifies The Vehicle Before It Can Be Sold. So there is no way the clutch could have been bad" Iam Starting To Doubt that the tecnician even looked at it!!!. So Long Story Short I Paid $ 1800 For A Clutch, Flywheel, Throw Out Bearing And Pressure Plate!!!!

I would have fought that harder. I work for a dealership and all they do when a used car comes in is look it over, take it for a test drive, check for leaks and make any repairs as necessary. They dont take the transmission apart or anything like that. Even though it was your fault i believe if you fought it you could have gotten the stuff fixed under warranty.

I hope you got the exedy twin for that price. Why would you let them put a stock clutch in for $1800?

I called a dealer about a gear syncro and forewarned them that I had drop springs and an open air filter. He told me that he would not even look at my car, then I asked him why and he yelled at me! He literally was like "YOU ARE NOT GOING TO MOD YOUR CAR AND THEN EXPECT ME TO FIX IT" It was really hysterical. To an extent he had a point, but come on, drop springs related to gear syncros? Not likely to be related at all imo. I went to a different dealer who looked at the car and they told me nothing was wrong with it and that slight "grinds" or "vibrations?" into gear was normal. I asked him that if I came back with a taperecorder if he would repeat that. He told me to leave and that there was nothing wrong with my car. NO jokes! Luckily shifter bushings fixed my problem.

I am remotely angered by the fact that they would deny you for having a turbo timer. And having a worn clutch is no proof of abuse, clutches dont last forever, and I would just pull the newbie-card on that one! I would have hired an attorney on that one.

Pertaining to the original thread topic, I would have the dealer you bought the car from give you your money back. They told you that there was a warranty still, so they have no choice but to refund you or to fix the car at no cost.

Question Help

OK so I want a vote- should I:
a) wait for the dealer to tell me if the warranty is void then persue avenues of getting my money back
b) wait for the dealer to tell me that the warranty is ok and keep the evo with necessary work (tires springs and clutch)
c) say screw you jerky come get the evo and give me my money back now

I know that the tires and clutch are wear parts but he said it was a stock evo with full warranty. At least he used quality parts, Tein racing springs and Zum clutch but the front tires are bald on the inside and new on the outside HELP!!! I am very worried about losing my car but I don't want to lose my wallet either

this car is bad luck

right after i posted on this thread i went out to get something to eat and heard a loud scraping noise coming from the front driver side rotor... on my way to the dealer ship it stopped.. i get there and the rotor is scratched pretty bad. so i tell the service rider what i heard... the guy tells me" it must have been a rock that got in there." ??????????????? what ???????? he says the tech. can take a quick look at it to determine if it is a rock but i have to pay $42.50... so i asked what the hell is the warranty for if i have to pay every time i bring it in!!!! he says," if it isnt a rock we'll fix but if it's a rock you have to pay on top of the $42.50.... then you know what i tell him , quote" you are f****** crazy if you think im going to pay!!!!" end quote.. im going tommorow and straitening that crap out..... that mitsu. is starting to **** me off...

My dealer sells and installs blitz or apexi turbo timers for $250. They told me about the deal the first time I went in their to get an oil change. They also told me that a catback and airfilter are ok. I checked with them before doing anything. Right now I have catback and just a K&N drop in. I also have a boost gauge and they have no problem with it at all.

Don't wait for them to tell you if the warranty is ok or not. First of all, your car might be a lemon...and they might try to delay so you pass the time frame to file for a refund under your state's lemon law! Also there might be a time limit to get a refund because of "misinformation". Look into your state laws. If they lied to you about the stock/warranty, imagine what else they might be lying to you about?? I'd say "c"!!
