I still call bs on this though. It would be easy enough to come up w/ another reason to fire him. I know if I whip it out at work, there's no way I keep my job. And hell, if I'm on the jury of that case, I deny him anything. You don't pull your dick out at work unless thats what they pay you for.

I whip mine out every time I pee. Is that grounds to get fired too? It's a little different than taking it out to show your boss. People brush their teeth, change clothes, all kinds of things in the restroom...

My point is, I just don't want to see his nasty *****, hell dunk them in the toilet bowl and flush that bastard!

Incorrect. Your employment can be terminated at any time in Texas without cause. If you have a contract that changes this at will agreement then of course this is different. Most people in Texas are employed At Will. Of course if you're in a large company that spans multiple states the company has likely different internal rules that they follow (but notice how many companies are moving to Texas in order to reap the low taxes and employer friendly laws?).

* remember that you can't be fired for not doing something illegal -- that's wrongful termination.

Being discriminated against due to religion, race, etc is Federal law not only state. Federal supersedes state... So yeah, you better have a good reason and hope the "firee" cannot connect the two in court. That is why most employers just ignore it.
Correct. Just don't be a dumbass and tell someone you're firing them because they are gay. Most employers I know that are bound by Texas law... follow that law, but they know that it's *better* to fire someone with cause than without so that they don't have to pay unemployment benefits. I've been on both sides of this (and in fact have been the one to do the "with cause" digging to prove that the person needed to be fired).

In the case of someone dunking their *****, I think that's a pretty clear cut sexual harassment issue and you'd be ok. Just log the warnings and if they ask for some sort of religious break (ie. they can lock the bathroom door) then you're good to go if they continue to be a nuisance about it. Honestly if I worked at a place and there was a guy exposing himself to me I'd make it an HR issue and if they didn't take care of it I'd post a few signs anonymously.

Sorry you're right. The "right to work" is about unions. It's the "At Will" that I was looking for.

Here's what the Texas Workforce Commission has to say about it:
http://www.twc.state.tx.us/news/efte...s_general.html

the basic rule of Texas employment law is employment at will, which applies to all phases of the employment relationship - it means that absent a statute or an express agreement (such as an employment contract) to the contrary, either party in an employment relationship may modify any of the terms or conditions of employment, or terminate the relationship altogether, for any reason, or no particular reason at all, with or without advance notice.

Bah, I went to check my wife's car with my nifty little tire wear indicator and low and behold, after 40k miles of no issues whatsoever, she has scalloping on the passenger rear outer edge of the tire. Coincidentally, we went to the Ohio Dr. Discount in Frisco/Plano...And I know they will not rotate anything with any kind of wear, not to mention I inspected it myself before going... I am done with those turd burglars. I am going to take it to PTP next week and have them do an alignment and balance on that wheel and go from there.

So it seems PTP is gonna have to start doing family rides as well! Maybe I should get it lowered while I am there and then I can autox it when I get some new tires.

Nothing like drinking literally quite a few gallons of alcohol in two nights in a row and then (last night) getting ended up in the hospital not because of alcohol but because having an allergic reaction to soy sprouts in a sammich from jimmy johns at 4am....

Like I said, you cannot fire someone based on that, unless they just don't sue you. I would request a refund for that class...

Thats about cleaning after SEX not taking a ****. Not even close. Also if he sues... remembers Texas is "loser pays state" now. So let him sue. No judge or jury is going to say yeah its OK to have sex in your companies bathroom then wash your ********* in the sink. Sorry but no no no.

There is a lot of case law which judges follow regarding this Jose. If I placed a pumpkin on my desk, let it ROT and stink up the workplace and claim I was worshiping the damn thing, then got fired; there is no judge that would allow that to proceed for freedom of religion. Seriously, where do you draw the line?

Lotus is a MF to get out of. It is so funny seeing people put both hands on the ground to get out of them!

The Greatest Speech Ever Made...
Chaplin did this 71 years ago and it's exactly about what's happening today. This is the most beautiful speech I've ever heard.
"You the people have the power to make this life free and beautiful. To make this life a wonderful adventure.
