My new Evo is broken help!!

Hello all. I recently purchased a 2006 Evo ix RS. Super clean beautiful and only 28,000 miles on it, the car I have always dreamed of. The catch?? I take it in for its 30,000 mile check up a bit early and guess what.... The transfer case had been switched with an evo 8 with the death whine!!!

So I guess I'm stupid for not getting it checked out by a dealer huh? Well not so much. I bought it from Ken Garff because I wanted to be sure I was getting a quality car and not one that some loaf was trying to dump after beating it to hell.
Well they pretty much told me I was SOL because the car was sold as is and that because I never explicitly asked is the car was all stock its not their fault.
I couldn't believe it. I would have been better off buying from a private seller. Also the sold me their "wrap" coverage that covers everything..... Except problems existing at the time of sale. So I bought a car that needed thousands of dollars of work and a warranty that wasn't worth a damn.

If anyone knows someone down at Ken Garff that can help me or a good lawyer please let me know asap. I cant believe such a reputable dealership would treat someone the way they treated me... This car is my life!

I work for the Mits in Ogden, i am sorry to hear about that. Ken Garff is a good dealership, but sadly stuff like this happens. Especially with Evos i have seen sooo many come in on trades and are trashed. I personally dont believe in any warranties other then the factory one. I dont get why they wont do any thing tho, because regardless of the "wrap" warranty you are still covered under factory. Mine is an 04 and just barely went out of warranty.

They told me the warranty was void because it had already had 2 owners.. But the real reason I presume is because the previous owner voided the warranty by modifying the car. As the transfer case has been replaced....

They told me the T-case would be under warranty when I was looking to buy the car. Why did you buy it with the t-case making that horrible noise? And did you see the paint overspray on the rear window and trunk?

But when they pull it up on the service screen is there a note that says that in fact it has been voided? The amount of owners do not matter on the warranty and depending on the modifications to what will void certain coverages.

That is infuriating because the sales manager not just some dopey salesman said it was voided b/c I was the third owner and not because of the T-Case.. So naturally I bought the bogus warranty. The finance guy also slipped up and mentioned that the previous owner had done quite a bit to the car...

It did but since the T case is off an 8 it no longer functions. The salesman on the day I bought it pointed out that the car had that cool function.. Little did I know it didn't work..

But what im sayin is that service would be the only ones who could tell you that for sure. If it is just a sales manager or finance guy they dont know there heads from there *** about the service end haha sorry but i would recommend talking with service and they can look it up

wow i'm sorry about your situation. I used to work at ken garff in ogden a little over a month ago. if there is anything that can be done logan (mr. burton) will be the guy to talk to. just pm him and i'm sure he will help you if there is anything he can do

Hey since I don't trust them or want to give them any more of my money could I come to the Ogden one and have you guys check it out. I honestly have had it with them, I want to picket outside the dealership and scare people away that's how frustrating this experience has been..

i have a friend who has a acd t case that they will sell. if you need it. its from a 2006

Thanks I will try that. P.S. I went to Solid and if anyone is looking for a legit place to take their car they were very nice and reasonably priced.
