The way mitsu has been I would say that they would not cover it. Added power means added stress means voided warrenty. Mitsu SUCKS!!!

Put it back to stock before he/she sees it. Think about it, they are taking extra measures to void evo warrenties. They are looking for anything.

Here's the thing. The transfer case has already been replaced under warranty with the mods already on it by the service dept. The service dept knows I have them on and they are cool with the mods but since this is like the 3rd transfer case, the factory rep has become involved. I dont think they would lie to the factory rep if I put it back to stock

Put it back to stock. Even though the dealer is ok with the mods it does not mean the rep will be especially now that you are going to another transfer case. He might even blame the mods on the vehicle for causing the transfer case to keep on breaking. One of the reason that a rep is going out to take a look at your car is because Mitsu is suspecting something weird is causing this problem over & over. Put it back to stock & don't even take the chance.

If he puts it back to stock and someone from the service departments tells the rep that it used to have mods on it then it will look like he is hiding something.

on the other hand the rep might just have to see for himself and if there is nothing then he might not be able to just take someones word for it that there used to be mods on the car.

I think it is a tough decision either way, keep us posted on what happens!!!

The reason the dealer rep is coming is that 3 broken transfer cases consitutes LEMON LAW possibilites. 3 strikes, same part. If you said the dealer has warrantied the TC the first 2 times with the modifcations then I would say your fine. At this point if they give you a problem there are alot of defenses for you....they have to prove your mods caused it ( it would be great if the first one failed unmodified, the second modified and the third moddifed)...also you have aribtration option with the lemon law...let us know what happens man!

but seriously, I really want to know how you drive normally.
Im at 22K miles and TC is still fine.
you still have stock clutch right? Do you like to Wheel Hopping? :P
Well, for your case I stil lthink putting back to stock as much as you can will be best. Your dealer and the Mitsu service rep are two different entities.

least put your stock exhaust in there. They can't warranty you unless you have a catalytic converter in your car, since without having one is against Federal law.

They wont give you hell about the other stuff, like intake and piping, but if you have a boost controller or something like that could change the boost or like an aftermarket clutch, they'll deny it. you can't win that.

Having delt with factory reps as a service manager, I can tell you that it is best to put things back to stock. You have a problem that your dealer has called in a factory guy to look at. If your dealer was going to dump you that would likely have happened before now. It is obvious that your dealer susects a manufacturing defect beyound the transfer case. He will be on your side here. Factory reps look at two things, the dealers work and manufacturing defects. It is these kinds of things that forment TSBs and cudos for the reps who discover them. Be aware thought that If these areas check out clean then you may have a problem you will have to pay for. That being said, do not provide the rep with anything that will allow him to deny your claim or cloud the problems cause. He will always look for the simplest explainations and easiest fixes first. He does this for a living and has to please his boss.

Good advice...but since the service manager already knows about the intake/exhaust...should I just tell him I am reverting it back to stock? It's going to be kinda obvious to him if I do

Revert it if able and say nothing to the dealership unless asked.

The burden of proof that your mods created the problem in the TC is on MITSUBISHI. They cannot just void it. Somebody help me here - Magnussen-Moss act or something like that.

It's really hard for me to believe that you can go through three transfer cases and not be "beating" on the car, or launching it inordinantly hard. Hard to believe. Are all of the transfer cases you are getting out of a bad batch? What are the chances of this? I'm thinking driver error has a lot to do with this, one way or the other. Mits has been gracious with you by replacing two of them. I would not have replaced the second without direct evidence that the part in question was defective or weak.
