that is fine they can "claim" what i have done caused the failure. It is their burden to prove that it did cause the failure, not mine. i've already asked for a detailed letter concerning the situation from mitsubishi. if my exhaust caused the failure they should be able to explain why. if my BC caused the failure they should be able to explain why. if over revving caused the failure they should be able to prove i did that. They have done nothing to prove my mods caused the failure but blamed them regardless.

I honestly do not care what i had on the car. i could have had an ice cream maker working out of the trunk and they would have blamed it. now they need to prove it. To many people have had their warrantys denied without mitsu proving it was a root of the failure. I understand when i'm getting ****ed but i'd like to have a dinner and drinks first.

i would love to see how this turns out. this could set a precedence for future warranty claims.

when you got 19.5 lbs of boost out the box with a 7500 rpm rev-limit, something has to fail. These are quality cars, but race cars do brake. If you race a car, it will brake. This is the dealers reasoning. You have an exhaust, intake, and mbc. You cant win if you dispute this. Your warranty has been voided because you race. If I was a dealer and someone came in with a blown motor in a high performance car, I wouldnt cover that. Lets view this logically. If you buy any high performance car, mod it, and you come back to the dealer with a problem, there is a 99% chance you will be denied. And thats pretty much the case at any stealership.

The one thing they have said nothing about is where did my oil go? It had to have burned off but i have heard nothing about what caused that.

ruthless evo 8: theoratically, there are only 2 reasonings why the oil is missing; if there were no leaks, then it has to be burnt off... which brings an interesting point... you didnt smell anything funny at all? or see fumes escaping the hood vent...

from what my understanding if from moss-magnuson is that they need to prove my modification caused the failure. I do not race so they are using speculation as their main basis of fact. There is so much speculation on the part of a dealership i don't understand how they win from the get go.

My mentality going into this is that i have nothing to lose. I already lost $5k so whats a little time on my part to fight something like this. what's the worst that could happen that i haven't already lost?

I understand the dealerships POV because I wouldn't want to shell out $5k to fix someones car they might not be responsible for it. I do pay for a warranty though and if I caused it I will own up to it. Until they can give me evidence that this is the case they need to cover it.

no there was no smell or fumes coming out of my block. They are trying to blame my mods for causing the engine failure when it is clearly oil related. The fact that they haven't even tried to address that is what makes me want to fight this. They need to have an explination for why my engine went from full to empty in 3 weeks. i was not leaking oil, car is parked in the garage every night, and the shop i went to did not fiddle with my engine or oil levels.

thats another thing. i was able to drive the car to mitsu. It was a pain in the *** but i was able to drive it.

If you put an aftermarket turbo on a car and the engine fails on its own they will blame the turbo. They won't even try to check and see if the engine crapped out on its own and its their responsibility. It is instantly your fault because of your mods. I'm suprisied that they didn't say my rotors caused it.

interesting... so when u took the car in, it was at least "drivable"... but after their diagnostic, they said that "the bottom end is blown", right?

which means the car, after their examination, is no longer drivable....

maybe thats a good starting ground for your case... do you see where im going with this?

didnt ur engine light come on at some point. I always check my oil levels once a week. But to burn all the oil out of the engine. this seems kinda funny.

The most important thing that I need right now is the letter from the dealership stating exactly what condition my car is in, what failed and needs to be replaced, and what is the cause of said failures.
