On what grounds? I definitely recognize that Ben got screwed here, and think he should receive compensation, however the only evidence he has to sue Accolade (and I don't think this is the best way to go personally) is the poor packaging and lack of results from all his correspondence. I think it'd be better to have it dealt with out of court. Did you order the kit through David or was this through ABK directly? Who shipped it?

I was not thinking about it actually. I ordered it from the accolade website through paypal. It said that a company named Strada was shipping it via Old Dominion Freight Lines (ODFL). David has done nothing but try to resolve it, but has not gotten anything from them. He said that he was gonna check with his people to replace my damaged pieces and told me to take pictures of it, which I though was for him to show to his people, but he was trying to get ODFL to rectify the situation again. So now I'm at a stand still and I will be moving from Michigan back to North Carolina on September 14th and would really like to have this done with and resolved by then. I mean I'm not the type of person who is gonna be mad about losing the money for not making it to a car show, but I would expect a better situation from having paid $900 for a product that should have been on my car almost 3 months ago! I got it on May 3rd and was supposed to have it installed on May 8th to be ready with everything by the show on June 9th, but I'm just hoping that David can stay on them to fix this. The last email from him said that ODFL had 30-45 days to do something, but if it does not work this time then I will need to do something else that I do not necessarily want to do! My credit card does cover issues such as this because my wife called and verified and I do have all emails before and since May 3rd, so I'm really hoping that David can come through in the clutch for me!

The fact is that you signed for the bodykit without exception...

ODFL informed us that their investigation was complete and they denied our claims..

I asked for pictures so that I could reopen the case.. and I asked for additional time granted so they would have ample response time since they only inform us through mail envelope..

But it sounds like you are growing impatient I dont blame you.. I will send out a replacement soon because Im getting tired of waiting to hear word from the truck company.

As for someone in the shipping and receiving industry, once I sign for something and it turns out to be damaged, it is often impossible to get the shipper to pay for the damages. That is why I am inspect each package before signing. If even hear something rattle I don't sign for and refuse as damaged. I have also refused items after watching the driver unload them. He was dropping them from the back of the trailor onto the ground.

lesson learned- don't sign unless you inpect first. but it sounds like dave is gonna take care of you. the hin exposure is really the only thing to be upset about. those girls are so hot!!!!!!!

and for those who fail to see what the problem is "I dont think that was Accolade fault" The shipping company, who ever they use, is to blame.... Now of course filing a claim takes time. EVEN if they are asked to for a fast conclusion. The reason the shipping is "expensive" (i couldn't think of another werd) is because you are also paying for insurance on the kit... so if it does come damaged then you *** could be saved.... Now if you wait to long or other **** f*cks up, they can deny the claim...

I did not spend $900 hard earned dollars for either of these problems, I mean this whole situation is not exactly driving customer loyalty, but David is trying to salvage it. When I first had problems, I emailed Ryan, Dimantha, Diran, and David. David was the only one who contaced me back! I mean right now I'm the only one losing money, I mean basically it is lost! I mean I am about to move back to North Carolina and I still have the kit just siiting around. I really wish that they could have just sent me a new kit and gotten this taken care of months ago! However, as it stands the kit is not on, I am out $300 bucks for having cancelled an appearance, will not make it to HIN with the kit installed, and am on a wait and see basis to see if this will be resolved before I move which is September 14. I really hope that this can be taken care of this time, but it is basically out of my hands now.

Dave cam through for me. He will be sending me a new kit, well not all knew, but basically new since everything was damaged, but the eyelids the grill and the left bracket for the spoiler! And you can bet your *** I will be there pesonally to inspect this **** when it comes in this time! I just need to know a timetable becuase like I said ODFL sucks *** and I need to know if I'll have the new stuff in in pleanty of time for me to move in september. I would like to say though that DAVE IS A PIMP! Thanks dude! it just sucks that it took so long! Since, I'm moving back to NC too, I might as well stop by their corporate office and give them a big spoon and a bowl so hey can eat my ****ing ***! SORRY EVERYONE! JUST VENTING!!!! It feels like the gorilla just jumped off my back, but until I do get the new stuff, he is still behind me! Yo Dave, I told Diman that you needed a raise! Also, what can I do about my hood latch so that I won't have to use hood pins becasue the grill on the front bumper once molded on will prevent access to the lever to release to hood from the latch and also, will a body shop be able to put washer nozzles in the hood without messing it up? I was mislead by the pic of the kit, there were washer nozzles on that hood, but mine came with out any place to put them. Dave, also can you send me any links that would explain installing the body kit. I'm gonna take it to a shop, but I would like to know what all you have as far as visual aids and what not. I recall seeing another thread that explained that the hoods don't have holes for washer nozzles, but they can easily be drilled. It's fiberglass, right? That's easier to drill holes in than carbon fiber.
