when I buy a car, I never think about the warranty now. Even, mercedes tried to blame on me for the warranty fix. and it took really long to fix it. Just don't consider that when you buy it. there are many pits and falls in any warranty. you buy as is and play russian roulette. If I think about the warranty I just lease the car and leave as the stock.

The factory says that the tires get rotated every 5k and the oil and filter gets changed also every 5k. If what you say is true, that dealer screwed up.

do yourself a favor and when you get the new clutch.. make sure it's aftermarket... my 03 clutch went out within 6k miles... oh and btw.. your calipers may start peeling too... or did they finally fix that problem?

See if you can get the dealer that sold you the car to write down what he said about the warranty. Also check your receipts and see what the mechanics wrote down at your 5000 mile service call. Then write a polite letter to the owner of the dealership and express how disappointed you are with the service department and that the sales agent lied to you. Then wait and see what type of response you get.
I did this when I purchased my evo. I had to return the car the second day of ownership due to 5th gear grinding, they gave me an unregistered used car as a loaner and the sales agent had told me that they did not do deal mark ups on the price of the car when I purchased it. However, they did mark up the price and disguised it as a dealer prep fee. Long story short, the owner personally called me at my house and apologized. He authorized me a rental car at no cost, and told the finance manager to write me a check for the full price of the dealer prep fee, just over $1300. And ensured all the repairs to my car were completed free of charge.

Look at your invoice, if they claimed that they rotated and did not then you have a pretty strong case for getting some help from the factory. If they noted that tires did not need rotation then you have a good case. If they told you that they didn't need it and they charged Mitsu for it then that is also a bonus for you. Keep me updated. The thing here is that they get paid from MMNA to do it. What were they thinking if they didn't? Are you on the factory maintenance program?

You say you bought it in August. I'm assuming that was Aug 2005. If that is the case then you have put about 4.5k miles per month. That is a lot of driving. That amounts to 54k per year. Are you sure that this was the right purchase for that amount of driving?

Here is where the defect could come from...

The car could be misaligned from the factory. I have almost 19,000 miles on my Advans, and NO CORDS are showing. And yes, there is negative camber on the car. If the clutch has under 12,000 miles, shouldn't it be covered under warranty? I can probably get another 5 to 10,000 miles out of my Advans (based on tread depth). Hope this helps.

Unfortunately you may be out of luck ..Typically those parts (tires/clutch) are not replaced under warrenty, like everyone said they are wear and tear parts. The only way you would be able to get them covered is if you have what the salesman/woman said down in writing. Unfortunately sometimes that even doesnt work.

Here's a quick one for you.. When I went to buy my Evo I went to a dealer that told me the price they'd give me for a trade in, price for the new Evo, all the incentives I would get, my monthly payment etc. I told them I would sleep on it and call them back the next day, and I DID have them write it down. I went in the next day with the deal they offered me on paper, and told them I would take it. The sales man sent the owner out to tell me they could NOT give me the deal, even though it was written down. After arguing with the OWNER of the dealership (East Providence Mitsubishi in RI, dirtbags) I decided to go on my merry way and keep looking. Even though I could have probably pursued the deal through legal matters, I didnt want to give them the sale.. Long story short, unfortunately its up to the buyer to double check what they tell you at the dealership.. Anyway, good luck..

On another note, I was down in NC last week visiting the family for thanksgiving. Unfortunately I didnt have my Evo, nor did I see one other Evo in 4 days! Dissapointing. I was all over the Wake Forest / Raleigh/Durham area too.

I work for a multi car dealer- handle the shop paperwork (ro's)- claim the warranty, pay the guys, in a nut shell I have to know warranty inside and out on 7 different car lines. I CANNOT speak for Mitsu, BUT the manufactures I deal with WILL pay for 1 clutch replacement, if it is within time span of 12months/12,000 miles. And, yes, If you have been side stepping the clutch, etc. that will be taken into consideration. I'd get Mitsu involved, call, find the regional DSM, what ever it takes and find out why they wouldn't pay for it. i.e. this a.m. just ran a clutch claim on a 2005 Audi S4, cluch plate failure.
Side note: Audi has a the free maint. programm, which up until 2005 was better than BMW.

The only way to know what is covered by the warranty is to READ the warranty coverage chart in the owners manual. Woul you ask the butcher about your leaking toilet? If I were evoVIchik, I'd go back to the original salesperson and ask them to put into writing what they told you. If they refuse, then I would ask them if they would also deny what they told you under oath in court, because you are considering filing a complaint with the state attorney general's office and this might go to trial.

I'd also tell the dealership that you fully intend to pursue this through every legal avenue available to you, if they don't make this right, including the BBB, small claims court and the state attorney's office. I would tell them that for starters you are working on a written complaint letter to send to the customer protection sections of the attorney general's office and the district attorney's office and that you have no doubt that what they've done constitutes fraud and deceptive sales practices and violates your state's state consumer protection law. If you have time, do some googling and you can probably find the specific law for your state so that you can cite it to the dealer (including the section number of the law). Maybe also mention that you are in the process of consulting with the state bar association to explore other potential private avenues of legal recourse.

Clutches should be covered under warranty until 12,000 miles. That's what the warranty states.

If you have driven the car properly then there should be nothing to worry about, let them tear into it.

Also, there should be a thread that was started a week or two ago regarding some of the EVOs that had misalignments from the factory causing improper wear on the tires. A car out of alignment will show excessive wear on the side of the tire while the rest of the tire will look normal. Any dealership that does alignments should spot this and those tires should be replaced regardless of whether or not they are a wear item.

You need to learn how to drive a manual car, no way the clutch failed so fast unless u have been doing some crazy launches.........
