This is in violation of the Magnusson Moss act of 1975 and can be fought in a court room very efficiently. The point is. If you prove, how much boost you're running, and it's like 1 - 2 psi over stock, you will win. Being that the car comes from the factory with a turbo charger, it comes with boost. Firstly, I would remove the BC, though, take it to a different dealer. If that doesn't work, then take them to court. You might even get a lemon law car if your lawyer is good enough.

This is an issue that will not be solved. The dealer has the right to void the warranty on your car as soon as you installed the boost controller. There is nothing that you can say, do, cry, scream about to them. Thats how it goes. The service writer has a form directly from Mitsu NA that states all of this info. There is a rep that goes around to the dealerships to follow-up on this. When ever an EVO comes in with some kind of waranty issue that seems a bit strange this guy comes out to approve anything that needs to be done. Im not talking un-even tire wear or a vacume leak. This guy will void your warranty and that gets entered into the computer along with your vin # and all of the dealerships get this info and its constantly updated.
Spend the moeny and take the loss.

another warranty issue, but this time its serious BS

Q: how'd they f**k you now?
A: First they said they wouldnt replace my 5th gear synchro (grinding) because i had an aftermarket clutch.

Then i pointed out that under the magnusson-moss act they cant deny warranty work just because there are aftermaket parts. It becomes their burden of proof to show the part caused the failure.

After that they called me back and said my warranty was void anyway since september 03 because of excessive modification although they didnt have a specific record of what the modifications were...and i wasnt the owner of the car at that point.

Finally after some argument they said, "we will tear down the transmission (at the possible cost of $500-$800) if you agree to pay for the tear down in the case that the clutch had something to do with the issue", and im sure they would "find" a connection.

Anyone push farther than this with success?

There's a bulletin on the transmission synchros. My fifth gear grinds, and my local dealer said they would fix it under warranty. They are going to replace 2nd, 3rd, and 5 gear. Another thing, this happened on the stock clutch...

They'll most likely blame you for the syncro & gear. It's a good trick on their part to get the ball rolling and you to cover the costs. Unless you can get them to say they'll warranty it before hand (or want to get a lawyer), I wouldn't give them the ok. Ever consider a shepherd racing rebuild? Just a thought..

Even with an aftermarket clutch my dealer fixed my 5th gear grind. Now for some reason they wont fix my 2nd and 4th gear grind.

Good luck on the whole issue.

Thats why the Moss Magnusson Act as it applies to modified vehicles is a joke. Chances are, a dealer or manufacturer would be able to provide sufficient evidence that just about ANY modficiation is capable of just about ANY failure. They could say a simple after market exhaust system increased horsepower beyond the capabilities of the transmissions design and that's why it failed. Right or wrong, who's an arbitrator going to beleive? Some kid who modified his car or a mechanic/engineer with a compelling argument? Or you could hire a lawyer. They're only $400 an hour.

It is easier said than done. When you have a Warranty issue please let us know how it turns out.

Im having my 5th syncro replace as well, but dont have a clutch yet. Thats the limit on tranny work I heard, once you have an aftermarket clutch, get to know shep's number well!

I had the exhaust causing to much hp for my trannsmission card pulled on my by coconut creek mitsubishi. They voided my powertrain only had 8000 miles left anyway. Shep Trans anyone? Christmas Vacation time spells a exedy HD twin disk and a shep rebuild for me should have about three grand by then for it all.
